Dear Mr. &,Mrs. Blank:
Thank you for your contiriued cooperation and patience in deliberatin~
with us in order to bring the negotiations for the acqui~ition of right-
of-way to a satisfactory conclusion. We are very pl~ased to have
heard from you this morning and have your decision that our letter
agreement wouJd be agreeable to you subject to the conditons of better
defining the li.mits of the work in your driveway area for the "bore-pit"
and the restoration of your driveway.
In view of the discussions to date we shall set forth herein the terms
and conditions of this letter agreement, integrating those specific
items that are containe~ in o~r original letter of October 8, 1980,
together with new lan~uage that is applicable to our situation as of
this date. Accordingly, we recite the follow.ing terms and conditions
under which yo~ are willing to consent to the ~ranting of the easements:

2. The owners agree to provide to the bistrict a 3,241.54 square foot,
20-foot wide temporary constructIon easement adjacent to the
20-foot wide permanent sewer easement, s,aid construction easement
to terminate at the completion of construction. We offer a total
compensation of $350.00, based upon an appraisal made by the District.
3. The District's contractor has elected to utilize a "tunneling method"
to avoid disruption of any landscaping in the front yard area
with the exception of the immediate driveway entry, where a "bore-pit"
will be constructed. Any small landscaping that is damaged in
this area will be fully restored to like kind.

4. With the changed method of construction there will be no manhole
located in your property in the front yard area.
5,. ,Along the rear property line (creek' boHom area) the contrac.tor
will work around all of the existing tree~, however, in the event
of damage, the trees w~ll be replaced in kind. In addition, the
contractor will try to preserve the firewoOd storage bin and
your underground barb'ecue pit. Again, in the event there is
damage, both facilities will be fully restored.
6. I n the front ya rd a'rea, the contrac tor w,i 11 be requ i red to full y
res tor e the d r i v e w ay pa ve d are a to a sat i sfa c tor y con d i t ion.. I n
addition, there will be provided a complet'e "seal"coat" for the
entire driveway area, so that the overall appearance can be
rest6~ed as near as possible to the original condition. All of
this work wi 11 be done to the satisfaction of the property owner.
We would appreciate your review of this latest presentation and if you
find the items satisfactory, we would appreciate your execution and
return of this letter agreement to this offi~e immediately. We
are also enclosing the "right of entry" form, which we ask you to
execute.
