D.D,.S. &niarlene, F,enn "Owner", ar.d poway' Municipal Water District herein called "District", in. view of the follo~ving , 1979 herein called facts: A. Owner has title to the following described real property situated in the County of San Diego, State of California, and within the boundaries of the District. 'The prqperty of O,vner is more parti- cularly described as follows,: 'THE 'NORTHERLY 165.00 FEET OF THE EASTERLY 290.50 FEET OF'THE WESTERLY 528,00 ,FEET OE THE SOUTH ,{ALF OF LOT 4 IN SECTION 31, TOWNSHIP 13 SOuTH,RNAGE 1 WEST, SAN BERNARDINO BASE AND MERI- -- - DIAN', 'IN THE' COUNTY'-OF~SAN-DiE&);' STATE' OF 'CALIFORNTA, ACCORD-, I~~TO UNITED STATES GOVERNMENT SURVEY APPROVED SEPTEMBER 21, 1875, (ASSESSORS TAX PARCEL NO. 278~170-44), B. The property of Owner is not adjacent to any water main of District, and Owner has applied for permission to connect ,.lith a District Rain at a location removed from their property for the pur- pose of providing a water supply for the property. C. District is willing to permit a temporary connection at its nearest main; providing Oivner agrees to and accepts the following terms and condit-ions. IT IS, THEREFORE, AGREED by Oivner, on behalf of themselves and their su~cessors in interest in the above described prop~rty, and District, as follows: 10 O-..m.er will,wi,thin six, (6) months from date of this agree- ment, make application for a meter and pay all District's regular charges and fee~, including District's installation and any required,backflow preventlon charges and connection and expansion fees, in effect at the time ,of installa,tion of a meter and service connection on, the Dis'trict ',i '-neares't main, and acquire any easement or encroachment permit which " " Page 1 of 4 i" .. I '1306" might be necessary to run a service lateral from the meter to the place of use on Owner's property. The cost of acquiring any such easement qr e~c~9achment permit, the installation a~d subsequent maintenance of the service lateral ext!"nding from the discharge side of .themeter shall be entirely at Own,er's expense, and the Dl.strict shall have no liabili'ty or responsibility therefor. 2. The conn'ection provided under the, terms of this agreement shall be available to serve water to the property of Owner, as above described, only so long as such connection shall serve only one parcel. Such service and use of the connection may pe terminated by the District upon thirty days' written notice addressed to Owner at their last known address on file in the 'District in the event the service is extended to any division of the property into two or more separate parcels to be served from such connection, or in the event of the construction of two or more residences-thereon.- 3. Should District or others hereafter install or provide a p,istrict water main adjacent to Owner's property or at a location from which District then determ~nes is to be the point of permanent coh- nection, the temporary connection permitted by this agreement shall, upon demand by the District, be terminated. After such termination, any future water service shall be provided by a connection to the new District main upon the payment to District by Owner of any charges ,and fees then established by District. The amount of such charges and ,fees shall include those District then charges for providing a meterahd's;:T7ice-to -the, ,nevl.main, together 'wi i:h such ot,her. reasori- able charges as District may establish, including a proportionate share of' the cost 0:E installation of su'ch riewmain. . 4. AnY' breach or violation of the terms and conditions estab- lished by this agreeme~t or of District,Is rules and regulations shall, at the optIon of District, permit District to terminate this agreement and the temporary connection if such ,breach or violation is not cured , within thirty days after written notice given Owner or their successors in interest' by District. In the event of such termination, District may disconnect the iinewithout any further liability or obligation . "to Owner ?r their successors in interest. . 5. . Owner hereby further agrees to participate in the formation of a special assessment district,. 'pursuant ,to the provisions of either the, "Mun,icipal Improvement Act of 1913" " or the "Improvement Act of 1911", 'for the construction and installation of a permanent water system. . Owner further acknowledges that th~c9st and expenses for said improvements will be as~essed over all properties benefi'ted from the works of improvement and Owner also ,acknowledges that his property will be' assess"edfor its proportionate share of the cos:ts of the works of improvement.
