hereinafter referred to as "Grantors", and the POMERADO
COUNTY WATER DISTRICT, hereinafter referred to as"Grantee",
WITNESSETH:
m~EREAS, District has commenced a condemnation
proceeding in the Superior Court of the County of San Diego.
Case No. 338018, seeking to condemn an easement for sewer lines
and appurtenances across the land of Grantors on November 29,
1972; and
VffiEREAS, parties hereto desire to settle this
litigation without further Court proceedings.
NOW, THEREFORE, IT IS COVENANTED AND AGREED
AS FOLLmIS:
1. Grantors will execute. have notarized and
deliver to Grantee upon execution of this Agreement an Ease-
ment for Sewer Lines and Appurtenances, a copy of which,
marked Exhibit "A" is attached hereto and incorporated
herein by reference thereto.
2. Grantors will further execute and deliver
herewith an Agreement allowing Grantee to take immediate
possession of the easement across Grantors' land for the
purpose of commencing construction of the se\~er pipeline
to be installed in the easement area. A copy of this
Agreement is attached hereto and incorporated herein as
Exhibit "B".
3. Grantee pays to Grantors, herewith, the
sum of Fifteen Hundred Doll~rs ($1,500.00) for the Easement
