COVENANT REGARDING REAL PROPERTY
The Whe,eler Family Trust 2-14-00, John W. Wheeler, Trustee, and Lois M, Wheeler,
Trustee, ("OWNER" hereinafter), is the owner of real property commonly known as 14465
Cheyenne Trail ("PROPERTY" hereinafter); and more fully descrioed as:
LOT 26 OF CITY OF POWAY TRACT NO, 89-13R THE HERITAGE PHASE 1, UNIT 1, IN THE
CITY OF POWAY, COUNTY OF SAN DIEGO, STATE OF CALlFOR'NIA, ACCORDING TO MAP
THEREOF NO. 13708, FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO
COUNTY, DECEMBER 17, 1998,
In consideration of the approval by the City of Poway ("CITY" hereinafter) of a Building
Permit for the constructioi"1 of a 574-square-foot guest suite within asing'le-family home,
OWNER hereby agrees that .no portion of the guest suite shall ever be rented or leased as a
separate unit, no complete kitchen facilities shall be installed, and no gas line and/or 220 volt
electrical service shall be installed.
This Covenant shallrun with the land and be binding upon and inure to the benefit ofthe
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement of all costs; including reasonable attorneys' fees, from the
other party.
