COVENANT REGARDING REAL PROPERTY
Lucille A. Johnson, Trustee of the Exempt Trust, under Johnson Family Trust Dated
October 21, 1991, as to an undivided 25% interest; and Lucille A. Johnson, Trustee of the
Survivor's Trust, under Johnson Family Trust dated October 21, 1991, as to an undivided 72%
interest ("OWNER" hereinafter), is the owner of real property commonly known as 13881 Poway
Valley Road ("PROPERTY"hereinafter), and more fully described as:
Lot 47 of City of Poway Tract No. 84-04R, in the City of Poway, County of San
Diego, State of California, according to map thereof No, 11603, filed in the Office of
the County Recorder of San Diego County, September 4, 1986,
In consideration of the approval of a Building Permit to construct a 723-square-foot guest
house on the above-referenced property by the City of Poway ("CITY" hereinafter), OWNER
hereby agrees that the guest house shall never be rented or leased as a separate unit and no
complete kitchen facilities shall be installed.
~~ ~~- - Tnis-Covenant'shall-run,with-the, land and_be_biDstil]g upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives;-transferees- and-
assigns of the respective parties.
In the event that a Building Permit is never obtained for the detached structure at the
request of the OWNER, the CITY shall expunge this Covenant from the record title of the
PROPERTY.
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party,shall be entitled to full reimburseli)e~t of all costs, incl,uding reasonable attorneys'
fees, from the other party. The CITY may assign to persons impacted by the performance of this
Covenant the rightto enforce this Covenant against the OWNERS.
