This Amendment to Grant of Temporary Construction and Emergency
Access Easement and Agreement ("Amendment") is entered into on
~I fie, :2.~ , 2009, by and between Robert C, and Bonita R Welch,
a trustees of the Welch Revocable Declaration of Trust dated July 24, 2000,
hereinafter referrecj to as "Grantor" and the City of Poway, a municipal
corporation, herei~afterreferredto as "Grantee," with reference 10 the following
facts, the truth and accuracy of which are acknowledged by Grantor and
Grantee,
RECITALS
A On May 9, 2008, Grantor and the City of Poway entered into an
Agreement entitled Grant of Temporary Construction and Emergency Access
Easement and Agreement ("Agreement"), The purpose of the Agreement was for
Grantor to provide to the City/Grantee a temporary construction easement and
permanent emergency access easement over portions of Grantor~s real property
in the County of San Diego, State of California, with the street address of 14812
Eastvale Road, and Assessor's Parcel Number of 278-181,04, and more
particularly described in Exhibit "An attached to the Agreement (hereinafter
referred to as the "Subject Property"),
B, As a part of the Agreement, the City/Grantee agreed to
compensate Gra'ntorfor the temporary construction and emergency access
easements by performing a one-time maintenance project on the Subject
Property, involving the slurry sealing of Eastvale Road and the private road
running north from:Eastvale Road in the area adjacent to Grantor's property, The

slurry seal work was to be performed within :six moriths of the execution of the
Agreement.
C, The City has determined that'it carinot perform the work described
in R~cital B above, because several property bwrier~ on Eastvale Road have
dedinedto gtanteasements to the City which are reqLiiredfor,theperformance of
the work, For that reason, the City is proposing 'to amend the .Agreement by
providing monetary compensation to Grantor in lieu of performing tlie slurry seal
project.
Now, therefore~, iii, consideration of the promises contained in this Grant
and 'Agreement, and other good and valuable consideration, Grantor and
Grantee agree asfdllows:
1, Section 3 of the Agreement entitled "Consideration" shall be
amended to read as follows:
As compensation fofthe Grant of the Easements described in paragraphs
1 and 2, Grantee shall .make a one,time payment to Grantor in the amount of
$1495,20, This amount represents the approximate cost'to perform slurry seal
work on the portion of Eastvale Road and the private road running north from
Eastvale Road, that rLins adjacent to Grantqr's prop'erty, The payment from
Grantee to Grantor shall be made within 30 days of the execution of this
Amendment.
2, All other terms and conditions of the Agreement shall remain in full
force and effect.

damage, resulting from, arising out of, or attributable to, in ,whole or in part, any
construction, reconst[ucti,9n, replacement; maintenance" repair, restoration, or

contractors, or arising out of or relating to this Grant and;Agreement or the use

12 Entire Aqreement. This Agreement constitutes the entire
