P-09-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING COMPREHENSIVE SIGN PROGRAM 08-02 ASSESSOR~S PARCEL NUMBERS 314-220-39, -40, and-41 WHEREAS, Comprehensive Sign Program (CSP) 08-02, submitted by Old Poway, LLC, Applicant, requests the approval of a Comprehensive Sign Program for Old Poway Village, located at 14005-14057 Midland Road, within the Commercial General zone and the Old Poway Specific Plan area, and WHEREAS, on November 3, 2009, the City Council considered the above- referenced item. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as follows: Section 1: The proposed project is Categorically Exempt from the California Environmental Quality Act (CEQA) as a Class 11 Categorical Exemption, pursuant to Section 15311 of the CEQA Guidelines, in that it is for the placement of minor structures accessory to (appurtenant to) existing facilities. Section 2: The proposed use is in accordance with the purposes and standards contained in the Poway Municipal Code and the Old Poway Specific Plan. Section 3: The City Council hereby approves Comprehensive Sign Program 08-02, pursuant to the plans on file in the Development Services Department dated August 6, 2009, subject to the following conditions: A. Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. B. All signs shall conform to the sign criteria and design guidelines contained within the Comprehensive Sign Ordinance of the Poway Municipal Code, as amended from time to time, and the approved CSP 08-02. C. Comprehensive Sign Program 08-02 establishes the following: 1. Front-facing, wall-mounted signs shall not exceed 15% of the wall area of the business' frontage. Signs facing Brighton Way shall not exceed 6 square feet in area. All wall-mounted signs are to be non-internally illuminated. 2. Eave-mounted signs are allowed for the spaces addressed as 14037, 14039, 14041, 14053, 14055, 14057 Midland Road. Eave-mounted signs shall not exceed 30 inches in height, nor 70% of the width of the suite. Resolution No. P-09-37 Page 2 3. Flag signs are permitted subject to the following criteria: flag signs shall not exceed 4 square feet, and are allowed to be displayed 24 hours per day on the center's rear building that include tenant spaces 14005A, 14005B, 14007, 14009, 14011, 14013, 14015, 14017, 14019, 14021, 14023, 14025, 14027, 14029, and 14031 Midland Road. Flag signs may also be displayed in the other tenant spaces (14033-14057 Midland Road) within the center during business hours only and must be removed each evening at the close of business. 4. Blade signs must maintain an 8-foot-high ground clearance. 5. Use of the following five colors for sign lettering: Red, Blue, Yellow, Orange, and Green, in addition to white. This sign program will allow different colors for trademarked tenant logos. Tenants with non- trademarked logos with different colors may be allowed, upon approval by the Director of Development Services, through the individual Sign Permit process. D. The large wood monument sign located within the center to identify tenant businesses is currently legal nonconforming with regard to height. The sign may be reduced to a maximum height of 15 feet and comply with the design shown on Page 11 of Comprehensive Sign Program 08-02 if required, pursuant to PMC 17.40.290C. E. Approval of this request shall not waive compliance with Chapter 17.40 of the Zoning Code and all other applicable City Ordinances in effect at the time of Sign Permit issuance. F. Prior to installing a sign, the applicant shall obtain a Sign Permit from the Planning Division and any necessary Building Division permits.
