2. The connection provided under the terms of this agreement
shall be available to serve water to the property of Owner, as above
described, only so long as such connection shall serve only one parcel.
.such service and use of the connection may ,be terminated by the Di!>trict
up'ori' thirty days' written notice addressed 'to Owner at their ,last known
address on file in the District in the event the service is extended to
any division of the property into t,wo or more separate parceis to be
served 'from such connection, or in t.he' ,event of the construction of two
or more residences thereon.
3. Should District or others h.~r~after install or provide a
District water main adjacent to Owner'. sproperty or at a location from
which District then determines is to bE?' the point of permanent con~
nection, the temporary connection permitted by this agreement shall,
upon demand by the Di~t?rict., be terminateq,. After such termination,
any future water service shall be proviged bya connection to the new
District main upon ,the payment to District by Owner of any charges
and fees then established by District. The amount of such charges
and fees shall include those District theIl cl1arges ,for providing a'
meter and service to the new main, together with such other reason-
able charges as District may establish, including a proportionate
share of the cost of installation of suchnew'main.
, 4. Arty breach or, violation of the terms and conditions estap-
Ii shed by this agr'eement ,or of District's rules and regulations shall,
at the option of Distric:t, permit District to terminate this agreement
and the temporary connection if such breach, or, violation is not cured
within ,thirty days after written notice given Owner or their successors
in interest by District. In the event of such termination, District
may disconnect the line without any further lJiability or obligation
to Owner or their successors in interest.
5. Owner hereby ,further agrees to participate in the formation
of' a special assessment di'strict; plirsuanttothe provisions of either
the "Municipal ImfirovementAct of19l3"; or the "Improvement Act of
191'1", for the construction andinstallati6n of a permanent water
system. Owner furiherac~nowledge!3 tl1~t the cost and, expenses for said
improvements will :be assessed' over ail. prqpertiesbenefited from the
works of improvement and Owner also, 'acknowledges that his property
will be aS,sessed for its proportionate share of the costs of the works
of improvement. Owner waives any right!>, at this time, to protest or
object to the formation of the assessment district.
