(NUISANCE ABATEMENT)
The CITY OF POWAY (hereafter, the "City") claims a lien on that certain real property
commonly known as 17215 Iron Mountain Drive, Poway, California, Assessor's Parcel
Number 322-041-36, and legally described as follows:
Parcel 3 of Parcel Map No, 5565, in the City of Poway, County of San Diego, State of
California, filed in the Office of the County Recorder February 10, 1977, in Book of
Parcel Maps at Page 5565, according to official plat thereof (hereafter, the "Property").
Pursuant to the terms of Poway Municipal Code Chapter 8.72, the owners of the
Property, James and Sharon Barbour, are indebted to the City in the sum of Eleven
Thousand, Seven Hundred Three Dollars and Sixty-Three Cents ($11,703.63), by
reason of failure to pay invoiced costs incurred by the City for a nuisance abatement
conducted at the Property.
The summary nuisance abatement occurred on or about January 3 and January 4,
2008. The Poway Municipal Code at Section 1.08.010(C) authorizes summary
nuisance abatement when there is an urgent need for the abatement for public health
and safety reasons. The right to seek judicial review of the nuisance determination has
expired.. '
The recording of this lien is authorized by Poway Municipal Code section 8.72.030(E),
which allows the City to assess a lien on property owned by the responsible party when
it has not been reimbursed within 30 days of notice for costs incurred in abating a
nuisance.
