EXTRAORDINARY DAMAGE. ~tshall be the obligation of each

Examples of' extraordinary' use are damage, cau~ed by :tractor type' vehicles
and dainage caused by heavy ,equipment (1 ton or over) such as'might be'used
during the construc',tiori,of a residence. 'Ordinary use of said'road will be
for pas~enger vehic~es"and::liglit truck (3/4 ton, or \i~ss) traffic. Ordinary
wear and 'tear ,or ordinary,'u",e shall be, that gradual arid over 'a period
wearing caused by such ordinary use. Ext,aordhnary use is ,causing
immediate damage ~itK,anyvehicle 'or any damage caused by a vehicle not
defined within ordinary 'use traffic.
5. INITIATION' AND MANAGEMENT'OFREPAIRS.

purporting to constitute such representation. A copy of the written state-

assessor's ,roll, at 'lea",t two' weeks prior to 'the 'commencement of any work

6. ADMINISTRATION OF COSTS". 'The property owner or owners
ini tiating repair", or c,apital improvements shali be, in' charge of making the
payments required for the, work of improvement. It shall be incumbent upo~
,all property owners to' contribute to the general fund to be used for main-
tenance or capital iIllproveIllent in accordance with ,the point computa'tions
referenced above. After the actual expenditure of funds by any owner or
group of owners ,such parties shall be e'ntitl'ed, to assess all other parties
to this Agreement in, 'acC-ordance with the 'f.o['mula set forth above. said
assessment notice: shall clearly,speclfy the expenditures, the purpose for
same, and the method of calculation. Upon receipt of any such notice of
assessment, the assessed property owner shall hav,eten -days in which to
dispute tl1,e assessment. :Failure to resolve' the dispute, shall- be ,remedied
byarbi tration as se,t forth hereunder . Omission by any assessed property
owner to give notice in writing within' the ten days of his dispute of the

agree as to an arbitrator, the arbitratio'ri shall, b.e ',admini'stered and the,

Association.

tain pr,ivate, roads to :standards prest'ribed by Taw, adversely impacts upon
tl1e' .hea'lth, safety ".nd ),welfare' of all residents thereof. The City fur,ther

to: this Agreement. Such assessment will be established in conformance with

City ,for costs incurred ,pursuant to Section (a) w'ithin sixty (60) days of
'receipt of a bi'll.i:ng from the City shan be deemed in violation of the.
agreement. The parties agree that said duty to' Ci ty;' not satis'fied ~ithin
the afo~esaid sixty (60) day,ped'od,' shall constitvte a Hen by City on
said property(s). This lien shall constitute 'an, encumbrance on the prop-

An easement for road ahd utility purposes over, under, along
and across a portion of the Northeast Quarter of the Southwest
Quarter of Section 17, Township 13 South, Range 1 West, San
Bernardino Base and Meridian in the City of Poway, State of
California, and more particularly described as follows:
PARCEL 1
The Southerly 40.00 feet of said Northeast Quarter of said
Southwest Quarter of said section 17.
PARCEL 2
The Easterly 20.00 feet of said Northeast Quarter of said
Southwest Quarter of said Section 17, excepting therefrom
the Northerly 614.16 feet thereof.
PARCEL 3
A 52.00 foot strip of land the centerline of which is more part-
icularly described as follows:
