Park .Creek Homeowners'.Association (hereinafter "GRANTOR") hereby grants to CITY OF POWAY,
(hereinafter "GRANTEE"), itssuttessors,or assigns, the Temporary Construction Easement and
incidents thereto for construction of a screen wall, removal of trees and volleyball court across that
certain real property in the,Cityof Poway, County of San Diego, State'. of California, described as follows:
(The Easterly 15 Feet of Lot.58 Map 9323)
The GRANTOR, hereby further grants to the City of Poway the privilege: and right to extend excavation
and embankment slopes within the limits of the hereindestribed Temporary Construction Easement,
where req'uired for the construction of said screen wall, removal of trees and volleyball court,
The GRANTOR, for him/herself, his/~ersuccessors and assigns, hereby waives any claim for any
and all severance damages to.GRANTOR's remaining property contiguous to the Temporary
ConstrLJction Easement resulting from acts or actions outside the control of the City of Poway or its
subcontractors or its agents.
The GRANTOR hereby further grants to GRANTEE the right to temporarily enter and construct
necessary related improvements as part of the propose'd construction process, This Temporary
Construction Easement, <;Is described, shall be valid only until the construction has been accepted by
the GRANTEE. After such time, the Temporary Construction Easementshall become null and void,
