RESOLUTION NO. 09-070
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPROVING THE TEMPORARY SUSPENSION OF THE BLOCK 4 AND BLOCK 5
WATER RATE INCREASES SCHEDULED FOR MARCH/APRIL 2010
FOR SINGLE FAMILY RESIDENTIAL CUSTOMERS
WHEREAS, on August 18, 2009, the City Council approved Ordinance No. 695,
amending Section 13.11.010 of the Poway Municipal Code, Schedule of Water Service
Charges, and Establishing Rates; and
WHEREAS, the new water rates approved by Ordinance 695 were approved
through a mandatory Proposition 218 process, in compliance with State law; and
WHEREAS, Ordinance 695 replaced the existing uniform water rate structure
with an inclining block rate structure, in which the water rates increase as consumption
increases; and
WHEREAS, on November 17, 2009, the City Council reviewed water
consumption data from the first two-month billing period for the inclining block rate
structure, to determine the initial effects of the new rate structure; and
WHEREAS, a concern has arisen that the pricing incentives for conservation that
are part of the new water rate structure are too prohibitive for single family residential
customers; and
WHEREAS, the City Council directed staff to determine if any modifications could
be made to the new rate structure to address that concern, while still meeting the City's
conservation goals for the fiscal year; and
WHEREAS, staff and the City's consultants have determined that one option to
modify the water rate structure to address these concerns is a temporary suspension of
that portion of the rate schedule set forth in PMC 13.11.010 which increases the Block 4
and Block 5 rates beginning in March/April 2010; and
WHEREAS, because the proposed temporary suspension of the Block 4 and
Block 5 scheduled increases will not result in the imposition of any new or increased
rates for any customers, that action does not require compliance with the procedural
requirements of Proposition 218.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: The foregoing recitals are hereby fully incorporated herein by
reference and are deemed a material part of this Resolution.

Section 2: The City Council of the City of Poway hereby approves temporarily
suspending implementation of the following Poway Municipal Code provision as follows:
A. Poway Municipal Code (PMC) Section 13.11.010, Schedule of Water Rates,
subdivision (B), Water Commodity - Single Family Residential Block Water
Rates effective January 2010 (March/April 2010 billings) - Block 4 and Block
5 only. All other provisions of Poway Municipal Code 13.11.010 shall remain
in full force and effect.
Section 3: The City Council of the City of Poway hereby amends the following
Poway Municipal Code provision as follows:
A. poway Municipal Code (PMC) Section 13.11.010, Schedule of Water Rates,
subdivision (B), Water Commodity - Single Family Residential Block Water
Rates effective January 2010 (March/April 2010 billings)- Range of
consumption units for Block 4 is amended to minimum units 81, maximum
units 135 and range of Block 5 is 136 units and above.
Section 4: This Resolution shall become effective immediately upon adoption by
the City Council of the City of Poway, California.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway
at a regular meeting this 15th day of December, 2009.
