RESOLUTION NO. 10-006
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DETERMINING THAT THE VETERANS PARK
IS OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT
WHEREAS, the Poway Redevelopment Agency is authorized to carry out the
redevelopment of the Paguay Redevelopment Project Area; and
WHEREAS, the Poway Redevelopment Agency, in partnership with the local
business and residential community, has identified a need for the Veterans Park to
increase the availability of passive park space in the community; and
WHEREAS, the Veterans Park is located within the Paguay Redevelopment
Project Area, and the improvements are necessary for the execution of the Project under
the provisions of California Community Redevelopment Law (Health and Safety Code,
Section 33000 et seq.), and pursuant to the Redevelopment Plan for the Project which
was adopted on December 13, 1983, by Ordinance No, 117 of the City Council and
amended on June 15, 1993, by Ordinance No. 415 of the City Council; and
WHEREAS, Section 33445 of the California Health and Safety Code requires the
City Council to determine that the project is of benefit to the Paguay Redevelopment
Project Area and that no other reasonable means of financing are available to the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: The City Council hereby determines that the Veterans Park will be of benefit
to the Paguay Redevelopment Project Area and the surrounding community in that the
improvements will maintain and maximize the availability of passive park space in the
community. Further, the project will meet goals listed in the Redevelopment Plan, as
amended on June 15, 1993, and in the Redevelopment and Housing Implementation
Plan, which include the acquisition and development of new parks and recreation
facilities to meet General Plan requirements and also, provide for open space.
Section 2: The City Council hereby further determines that these improvements will
assist in creating a physical and economic environment in the project area that will
support private reinvestment in both residential and commercial facilities by existing
property owners and potential developers that will eliminate physical and economic
conditions of blight, including investments that will help to overcome depreciated or
stagnant property values, abnormally high business vacancies, and conditions that
prevent of substantially hinder the viable use of buildings.
Section 3: The City Council further determines that no other reasonable, means of
financing the improvements are available to the community.
Section 4: The City Clerk shall certify to the adoption of this Resolution.
