Ord 164 ORDINANCE NO. 164 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA AMENDING CERTAIN SECTIONS OF TITLE 17 (ZONING DEVELOPMENT CODE) OF THE POWAY MUNICIPAL CODE WHEREAS, the City Council periodically finds it necessary to amend Title 17 (zoning Development Code) of its Municipal Code in responce to changing conditions within the City; and WHEREAS, the City Council held a duly advertised public hearing to provide interested parties the opportunity to address the proposed amendments. NOW THEREFORE BE IT ordained that the City Council hereby adopts the following amendments as part of Title 17 (Zoning Development Code) of the Poway Municipal Code: SECTION 1: Amendments to the following sections of the Municipal Code are hereby established and shall read as shown in Attachment 1 by a dashed underline for addition: 17.08.100.F - Group Residential 17.10.130.E - Side Yard Setbacks - Commercial Zones 17.12.130.E - Side Yard Setbacks - Manufacturing Zones SECTION 2: The City Council of the City of Poway hereby finds that these amendments are consistent with the General Plan and the intent and purpose of the zoning Development Code. SECTION 3: The City Council of the City of Poway hereby finds that these amendments will not cause significant adverse impacts on the environment and issues a Negative Declaration. P P P P P P P P P P P P P P SECTION 17.10.120 PROPERTY DEVELOPMENT STANDARDS: C ZONES The following property development standards shall apply to all land and buildings permitted in their respective cc~mercial zones. Any legal lot may be used as a building site, except no building permit shall be issued for any lot having lot size of less than 4,000 square feet. Each building site shall have a minim~ 20-foot wide vehicular access to a public street. 17.10.130 General Requir~ents The following requirements are minimums unless otherwise stated. CO CN CG CC A. Off-street parking (see Chapter 17.42) 17.10.140 Special Requir~ents In any C Zone, a minimum setback of twenty-five (25) feet shall be required wherever a lot in the C zone abuts a lot in any residential zone. Said setback may be used for required open off-street parking areas. The setback may be increased by the City Council in situations were additional distance would help to mitigate or alleviate potential problems or hazards. Bo In any C zone, the average frontyard setback shall be no less than the minim~ of the zone. The minim~ setback shall be no less than ten (10) feet.
