AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
PROHIBITING USES IN CONFLICT WITH RV-8 ZONING
ON PARCEL 317-474-01 AND
DECLARING THE URGENCY THEREOF.
THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
Section 1: T.M. 4203, on real property described therein, has come
before the City Council for approval of a 24 unit residential condominium.
The City Council finds there is a clerical and/or administrative error
regarding the zoning upon said parcel. The City Council intends to correct
and/or clarify said error by directing a study to find the source thereof
and, thereafter, rezone said parcel.
The Council finds that the error herein addressed is a
substantial risk to the general welfare of the community and adopts this
Ordinance as an urgency measure to prevent a use in conflict with
anticipated zoning upon said parcel.
The Council finds that this action is exempt from the
California Environmental Quality A~t; pursuant to Section 15108 of the
State EIR guidelines (14 Cal. Admin. Code S15108) as an action to protect
the environment; pursuant to Section 15071(c) of the State EIR guidlines
[14 Cal. Admin. Code S15071(c)] as an act to prevent an emergency and/or
harm to the general welfare of the community.
Section 2: The Council directs all City agencies to cease
processing T.M. 4203 and specifically, but not limited thereto, not issue
any building and/or grading permits.
Section 3: URGENCY CLAUSE
This Ordinance is an emergency measure that is
necessary for the immediate preservation of the public peace, health,
welfare and safety within the meaning of Government Code S25123.
Therefore, this Ordinance is effective immediately.
The reasons constituting the emergency are those
reasons set forth in Section 1 above.
