Ord 178CRDINANCE NO. 178 AN ORDINANCE OF THE CITY GOUNCIL OF ~HE CITY OF POWAY, C~LIFORNIA AM~E)ING SECTIONS 17.08.190(D), 17.10.150(I ) 17.12.150(C), and 17.17.040(K) OF THE ZONING DEVELOPMENT fi)DE AND AMENDING SECTION 16.18.030(11) OF THE SUBDIVISION ORDINANCE ASD ADDING SECTIONS 17.16.050(M), 17.20.050(G), and 17.22.050 R]~_4%RDING U~D~ING OF UTILITIES WHEREAS, it is the desire of the City Council to make the requirements for undergrounding of utilities uniform throughout the Development Regulations of the Municipal Code. NOW THEREFORE, BE IT ORDAINED THAT: SECTION I: Amendments: Section 17.08.190(D) of the Residential Zones, Section 17.10.150(I) of the Omt,,~rcial Zones, Section 17.12.150(C) of the Manufacturing Zones, and Section 17.18.040(K) of the Planned Residential Zone shall be amended in their entirety to read as follows: Ail utility connections shall be designed to coordinate with the archi- tectural elements of the site so as not to be exposed except where necessary. Pad-mounted transformers and/or meter box locations shall be included in the site plan with any appropriate screening treatment. Ail new and existing utility connections within the boundaries of the project shall be placed underground. Transformer, terminal boxes, meter cabinets, pedestals, concealed ducts, and other facilities appur- tenant to such underground facilities may be placed above ground. The requirement for undergrounding existing utilities shall not apply to any overhead power transmission lines in excess of thirty-four thousand five hundred volts and long distanceandmaintrunkc~tl~unication faci- lities. The requirement for undergrounding existing utility connec- tionsmay be waivedor modified by the City Council in accordance with criteria and provisions for such as adopted by resolution of the City Oouncil. B. Section 16.18.030(11) of the Subdivision Ordinance shall be amended to read as follows: 16.18.030 Imsrovements required. A. Transformer, terminal boxes, meter cabinets, pedestals, concealed ducts, and other facilities appurtenant to such underground facilities may be placed above ground. The requirement for undergrounding existing utilities shall not apply to any overhead power transmission lines in excess of thirty-four thousand five hundred volts and long distance and main trunk cc~,,mmication facilities. The requirement for undergrounding existing facilities may be waived or modified by the City Council in accordance with criteria and provisions for such as adopted by resolution of the City Council. Ordinance No. 178 Page 3 EFFECTIVE DATE: This ordinance sb~all t_~_ke effect and be in force thirty (30) days after the date of its passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation published in the City of Poway.
