AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
AMENDING SECTION 16.10.080
OF THE POWAY MUNICIPAL CODE
TENTATIVE MAP EXTENSIONS
WHEREAS, the City Council of the City of Poway has held a
public hearing to solicit comments both pro and con; and,
WHEREAS, an environmental assessment has been reviewed by the
Planning Staff and no significant adverse environmental impact will
result from this project, and the City Council hereby issues a
Negative Declaration.
NOW, THEREFORE, BE IT ORDAINED that:
Section 1: Section 16.10.080 is amended in its entirety to read
as follows:
16.10.080 Tentative map extension. A. The subdivider or
authorized agent may request an extension of the expiration
date of the'approved or conditionally approved tentative sub-
division or parcel map by written application to the Planning
Services Department, filed not less than ninety days before
the map is to expire. Such application shall state the reasons
for requesting the extension.
B. The Director of Planning Services shall review the
request and submit the application for the extension, together
with a report, to the City Clerk who shall set the matter for
public hearing in the same manner as prescribed in Section
16.10.020. Said hearing on the application for the extension
shall occur prior to the expiration of the map.
C. A copy of the Director's report shall be forwarded to
the subdivider prior to City Council action on the request.
D. The City Council shall act upon the extension request
upon the closing of said hearing and may either approve,
conditionally approve, or deny the extension. Until the decision
of the Council is made, the tentative map shall be considered
extended. Said decision of the Council to extend the tentative
map shall be from the date of expiration and not the date of
Council decision. The Council's action shall be in resolution
form which, if the extension is approved, shall specify the new
expiration date of the tentative subdivison or parcel map. No
more than three separate extension requests shall be allowed, and
the total of all extensions shall not exceed a total of three
years. The City Council may not impose any new conditions or
revise existing conditions on the approved tentative map. The
action of the City Council on extension requests shall be final.
A reasonable fee shall be charged for the processing of any such
extension, as set by City Council resolution. (Ord. 80 §l(part),

EFFECTIVE DATE: This ordinance shall take effect and be in force
thirty (30) days after the date of its passage; and before the
expiration of fifteen (15) days after its passage, it shall be
published once with the names and members voting for and against
the same in the Poway News Chieftain, a newspaper of general cir-
culation published in the City of Poway.
Introduced and first read at a regular meeting of the City
Council of the City of Poway held the 26th of November, 1985, and
thereafter PASSED AND ADOPTED at a regular meeting of said City
Council held the 3rd day of December by the following roll call
vote:
