corporation, have performed, to the satisfaction of the City of Poway,
all the terms, covenants and conditions contained in that certain
Agreenent Regarding DeveloFanent, dated DecemUer 30, 1985, by and betweeri
the City of Paaay and CF Poway, Ltd., a California Limitecl Partnership
which was recorded Januaiy 8, 1986 as File No. 86-008613 of the Official
Records of San Diego County, as said provisions apply to.Int 38 of the
City of Paaay Tract 85-04, Unit No. 1 in the City of Paaay, County of
San Diego, State of California, according to Map thereof No. 11742,
filed in the Office of the County Recorder of San Diego County, March 9,
1987; and
The City of Pv,aay does hereby further aclmaaledge that as to said
Lot 38 of the City of Poway Tract 85-04, Unit No. 1, pursuant to
Paragraph 4 of said Agrcenent Regarding Development, said Agree�c�nt
Reqarding Develo��ent is cancelled and of no furtlier force or effect.
