- DECLARATION-OF TEMPORARY COVENANTS -- -
This Release and Cancellation of Deve3opment Agreement and
Declaration of Temporary Covenants (the "Release!'), is made by the
CITY OF'POWAY (the "City"), with respect,to the following
matters. The City hereby declares'a's follows:
1. The real property described .in Exhibit A attached
Hereto and incorporated herein by this reference is the subject
of this-Release (the "Property"). The.Property is located
the development referred to as the Pomerado Business Park.
2.. All building and r,elated on-site and off-site
improvements within all phases of the Pomerado Business Park with
respect to the Property have been completed.
3. Upon the written request of the owner of the Property
and,pursuant to.and.i,n accor-dance with.the terms of that certain
Development Agreementiexecuted by and between the Cityiand the
current.owner's predecessor in interest, dated,December 30, 1985,
and recor,ded January 8, .1986'as File No. 86-008613 of the
officia`l records of the 12ecorder of San Diego County (the
"Development Agreement"), ,said Development A,greement is hereby
determined and deemed to be canceLed, released, terminated, and
of no -further force or effect as to the Property only.
4. �Upon the written,request of the owner of the Property
and pursuant to_ and in accordance with the terms of £hat certain
Declaration of Temporary eovenants ��ec:ntEd by fhe current
owner`s predecessor in interest to satisfy the requirements of
the Ci-fy arid for the benefit of the City, dated February 24.,
1987, and recorded Mareh,9, 1987 as File No. 87-122503 of fhe
officia-L r-ecords of the Reeorder of San Diego County (the
"Declaration"'')�, said:Declaration is hereby determined-and deemed
to be:canceled_; released, terminated, and of no further force or
effect as to the Property only.
