GOVENANT REGARDING REAL PROPERTY
Ronald C. Earl and Carolyn J. Earl, Husband and Wife as Joint Tenants ("OWNER"
hereinafter), are the owners of real property commonly known as 1'3451 Calle Colina, Poway, CA
("PROPERTY hereinafter), and more fully described as:
Lot 86 of Silver Saddle ,Ranch, in the County of San .Diego, State of Califomia,
according to Map thereof No. 7478, filed in the office of the County Recorder of San
Diego County, November 9, 1972.
In consideration of the approval by the City of Poway ("CITY" hereinaffer) of a Building Permit
to remodel a 500-square-fooY portion of the house on the above-referenced property into an attached
guest house, OWNER hereby ag�ees that the guest house shall never be rented or leased as a
separate unit, and no complete kitchen facilities shall be installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs, personal representatives transferees and assigns of the
respective parties.
In the event that a Building Permit is never obtained to construct the proposed guest house ai
the request of 1he OWNER, the CITY shall expunge this Covenant from the record title of the
PROPERTY.
If either party incurs costs as a result of filing a civil ,action to enforce the provisions of this
Covenanf ,: the prevailing'paity`shall be'entitled to full reimbursemenf of all costs, including reasona6le
attorneys�'fees, from the other party.
