AN ORDINANCE OF THE CITY OF POWAY~ CALIFORNIA
AMENDING SECTION 2130 et seq. OF THE SAN DIEGO COUNTY
ZONING ORDINANCE ADOPTED BY REFERENCE ESTABLISHING
MAXIMUM DENSITY DESIGNATORS FOR C-31 COMMERCIAL AND
REQUIRING MAJOR USE PERMIT PROCEDURES FOR
GROUP CARE USE WITHIN SAID ZONE
THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA DOES ORDAIN AS FOLLOWS:
Section 1. The City Council finds it would be in the best interest
of the City to require a Major Use Permit procedure for Group Care
facilities within the Poway City area in order to better control the
design and utility of said facility. This, to provide better use of such
facilities within the City area and thereby better protect the public
health and welfare.
The City finds that current zoning law is unclear as to
the maximum dwelling unit per acre density available for residential
development of commercial zone C-31.
Section 2. Section 2310 et seq. of the San Diego County Zoning
Ordinances, as adopted by reference by the City of Poway, are amended to
read as follows:
(a)
"Group Care" under section 2312b shall be deleted from said
section and added to section 2315a (Uses Subject to a Major
Use Permit; a. Civic Use Types).
(b)
Section 2990 (Use Matrix) of said Ordinance will be amended
by placing an "M" under "Group Care" (1345) in lieu of the
black dot designation in row C-31.
(c)
Notwithstanding any other provisions contained within said
Zoning Ordinance, the maximum density designator for
residential development within C-31 commercial zone shall be
10.9 (dwelling units per acre).
(d) Should applicant propose construction of multi-family rental
units, the maximum density designator may be 14.5.
Introduced and first read at a regular meeting of the City
Council of the City of Poway held the 3rd day of March, 1981 and thereafter
PASSED AND ADOPTED at a regular meeting of said City Council held the 10th
day of March , 1981 by the following vote:
