Res 10-019RESOLUTION NO. 10 -019 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY FINDING THAT THE PURCHASE AND SALE AGREEMENT FOR THE PROPERTY KNOWN AS THE POWAY ROYAL ESTATES MOBILEHOME PARK IN THE CITY OF POWAY IS IN CONFORMITY WITH THE CITY'S GENERAL PLAN WHEREAS, the City of Poway City Council, (the "City "), desires to approve a Purchase and Sale Agreement and Escrow Instructions between the City, as seller, and Hometown Community Limited Partnership, as buyer, (the "PSA ") for the Poway Royal Estates Mobilehome Park in the City; and WHEREAS, the City Council, acting as the City Planning Commission ( "City Council ") held a meeting on May 4, 2010, to consider, among other things, whether the PSA and sale are in conformity with the City's General Plan; and WHEREAS, the City Council has reviewed the PSA; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY, ACTING AS THE CITY PLANNING COMMISSION, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The facts set forth above are true and correct and are a substantive part of this resolution. Section 2. The City Council hereby finds that the disposition of the Poway Royal Estates Mobilehome Park (the "Site ") is consistent with the Poway General Plan in that the disposition of the property will not modify the existing use of the Site in any way. The General Plan land use designation and zoning of the Site is Mobile Home Park (MHP). This is a unique land use designation and zone in which mobilehome parks are the only permitted land use. The land use designation and zone preclude existing mobilehome parks from being converted to other uses and vacant MHP land from being developed with uses other than mobilehome parks. As the Site is developed with a mobilehome park and the Site is designated Mobile Home Park (MHP) on the City's Land Use and Zoning map, the use and operation of the Site as a mobilehome park are consistent with the General Plan Land Use Element and the Poway Municipal Code. The City's Housing Element, a component of the General Plan, makes reference to the Site. As a mobilehome park, the use and operation of the Site are consistent with the goals, policies and strategies of the Housing Element. The Site is an existing, operational mobilehome park. It is proposed that such use will continue following the disposition of the property. Accordingly, the Site is currently and will remain consistent with the Poway General Plan after disposition of the property. Further, the repairs and renovations contemplated by the PSA will not modify the property in any substantial way and will not impact the Site's consistency with the General Plan.
