A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
APPROVING ACCEPTING AN IRREVOCABLE OFFER TO DEDICATE REAL
PROPERTY, NOT PREVIOUSLY ACCEPTED BY THE COUNTY OF SAN DIEGO,
AT 12315 OAK KNOLL ROAD
WHEREAS, pursuant to Section 7050 of the Government Code, George F.
Sterne and Diversified Financial Systems, 77 -1, made an irrevocable offer of dedication
to the County of San Diego for public highway, recorded in the Official records of San
Diego County, California, on October 18, 1978 book 1978 file /page 78- 445159 (Exhibit
A); and
WHEREAS, the County of San Diego consented to the recordation of the
irrevocable offer of dedication at that time; and
WHEREAS, when the City of Poway incorporated in 1980, the City succeeded to
all property rights held by the County within the City's boundaries; and
WHEREAS, public convenience and necessity will be served if the irrevocable
offer of dedication is accepted by the City; and
WHEREAS, the City of Poway accepts the Irrevocable Offer to Dedicate Real
Property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway, pursuant to and in accordance with the authority contained in Government Code
section 7050, as follows:
Section 1 : The City Council hereby finds and determines the foregoing recitals are
true and correct.
Section 2 : All portions of the Irrevocable Offer to Dedicate Real Property, described
in Exhibit A, attached hereto and incorporated herein by reference, is hereby accepted.
Section 3 : The City Clerk is hereby directed to cause a certified copy of this
resolution, attested by the City Clerk under the seal of the City, to be recorded in the
Office of the County Recorder of San Diego County, California.
