CC 2002 07-16CITY OF POWAY, CALIFORNA MINUTES OF THE CITY COUNCIL REGULAR MEETING JULY 16, 2002 The July 16, 2002, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. Motion by Councilmember Goldby, seconded by Deputy Mayor Emery, to approve the remainder of the Consent Calendar as follows: 5. Ratification of Warrant Register for the Period of June 17-21, 2002. (401-10) Approval of Minutes - City Council June 18, 2002 - Regular Meeting Adoption of Resolution No. 02-087 - Approving Program Supplement M004 to the Existing Local Agency-State Agreement for Federal-Aid Projects for the Extension of a Fiber Optic Traffic Signal Communication Line. (401-30) Adoption of Resolution No. 02-088 - Establishing All Way Stop Controls at the Intersection of Orchard Bend Road and Rostrata Road; installation of an AC berm to eliminate the southbound to westbound free right turn, and the extension of the curb on the southeast corner of Orchard Bend Road and Rostrata Road. (602-01 #1548) Motion carried 4-0 with Councilmember Higginson absent. 7583 Page 3 - CITY OF POWAY - July 16, 2002 ITEM 1 (1002-01 R) ENVIRONMENTAL ASSESSMENT 02-09 ACQUISITION OF PROPERTY - 14303 SYCAMORE AVE OWNERS: MATZ RUDOLPH AND MAXINE FAMILY TRUST ITEM 2 (1002-01 R) ACQUISITION OF PROPERTY - 14306 SYCAMORE AVE OWNERS RICHARD AND LAURA BAUER ITEM 3 (1002-02R) ACQUISITION OF PROPERTY - 14302 SYCAMORE AVENUE OWNER: DANIEL YAKOUBIAN Mayor Cafagna opened the public hearings. Staff report by City Manager Bowersox. On October 30, 2001, the Council authorized staff to conduct site due diligence and negotiate the purchase of three parcels, totaling 3.91 acres, to pursue the development of potential sports fields. Acquisition of these parcels is consistent with previous direction from the Council to acquire flood-zone property for potential sports fields. The subject parcels are located within the 100-Year Floodway of Rattlesnake Creek. Staff is recommending approval of the Negative Declaration, and adoption of the Resolution approving the Environmental Assessment and authorizing the expenditure of $480,815 for the purchase of APNs: 314-182-24, ,50 and 51 located at 14303 Sycamore Avenue; $413,600 for the purchase of APN 314-182-33 located at 14306 Sycamore Avenue and $544,850 for the purchase of APN 314-182-35 located at 14302 Sycamore Avenue. The following people were present wishing to speak in opposition to the proposed sports fields: Jane Garcia, 14263 York Avenue Lyle Kimball, 14305 York Avenue Sandra Dillard, 14225 Sycamore Avenue Richard Foley, 14356 Sycamore Avenue, stated he was not opposed to the sports fields but was concerned with traffic and the flood control channel disruption. Linda Gordon, 13536 Aubrey Street, expressed concerns with traffic, saving the trees, roadway access, lighting, hours of operation and maintenance of the property in the interim prior to development. Motion by Councilmember Goldby, seconded by Deputy Mayor Emery, to close the public hearing, issue a Negative Declaration, adopt Planning Resolution No. P-02-36, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Environmental Assessment 02-09 Acquisition of Sycamore Avenue Properties Assesso(s Parcel Numbers 314-182-24, 33, 35, 50 and 51." Motion carded 4-0 with Councilmember Higginson absent. 7584 Page 4 - CITY OF POWAY - July 16, 2002 ITEM 10 (1160-01) ALL WAY StOP CONTROLS AVENIDA FLORENCIA VIA DEL TORO CAMINO DEL VALLE This item was requested to be pulled by a member of the public for discussion. Since August 1998, staff has been working with residents to address their traffic safety concerns and issues. In 1998, residents' major desire was to install all way stop controls at the intersection of Avenida Florencia and Camino del Valle. The Traffic Safety Committee and Council approved the signs, which were installed in November 1998. On April 13, 1999, the Traffic Safety Committee again reviewed a resident- initiated staff report on conditions on Camino del Valle. The request was for another set of all-way stop controls to be installed at Via del Toro and Camino del Valle to dissuade cut-through traffic and slow others down. This request was dropped after the poll of the neighborhood revealed that neighbors who lived in the vicinity of the proposed stop signs were not in favor of them. In September 2001, Dr. Browning sent a letter requesting actions be taken to reduce the speeds in the area. A neighborhood survey was prepared and sent to over 200 area residents on March 12, 2002. Over 125 residents responded. On May 9, 2002 a neighborhood traffic workshop was held with residents of the Valle Verde Ranch area to address their traffic concerns. Residents identified three problems they would like addressed on both Camino del Valle and Avenida FIorencia: vehicle speeds, unusually high traffic volume and safety concerns. Based on the survey, three options had the most support: 1) Cul-de-sac on Avenida Florencia between Camino del Valle and Avenida Granada; 3) All-way stop controls at Camino del ValleNia del Toro and at Avenida FlorenciaNia del Toro and 6) do nothing. Based on the differences of opinion on the suggested solution, staff determined that a neighborhood workshop should be conducted to better define the problems, educate residents on the measures available and then determine acceptable solutions. The workshop was held on May 9, 2002 with a total of 26 residents in attendance. The residents agreed on the following solutions: 1) Install an all-way stop at the Avenida FlorenciaJia del Toro intersection; 2) install an all-way stop at the Camino del ValleJia del Toro intersection; 3) use some type of road narrowing technique on Avenida Florencia, Camino del Valle and Avenida la Valencia; 4) install equestrian crosswalks on Avenida la Valencia and on Avenida Florencia. The Traffic Safety Committee recommends implementation of solutions 1-4 with exception of 3 and direct staff to work with community representatives to develop concepts (physical narrowing of the roadways at intersections). The following people were present wishing to speak: Larry Fromm, 12810 Via del Toro, spoke in opposition to the installation of stop signs and stated he felt a physical barrier would be more effective and better looking such as a landscaped roundabout. 7585 Page 5 - CITY OF POWAY - July 16, 2002 Robert Nelson, 12922 Camino del Valle, spoke in support of the recommendation. Edward Kreusser, 12926 Via del Toro, spoke in support of staff recommendation. Motion by Deputy Mayor Emery, seconded by Councilmember Rexford to adopt Resolution No. 02-089, entitled, "A Resolution of the City Council of the City of Poway, California, Establishing All-Way Stop Controls at the Intersection of Avenida Florencia at Via del Toro and for Camino del Valle at Via del Toro," staff to continue to work with the neighborhood on additional concepts. Motion carried 4-0 with Councilmember Higginson absent. CITY ATTORNEY ITEMS 13A. City Attorney Eckis requested a Closed Session be held: Conference with Real Property Negotiator Government Code Section 54956.8 Property: 12764 Poway Road, APN 317-490-72 Negotiating Parties: James L. Deputy Mayor Emery inquired as to the status of the NPDES inspection permit fee report previously requested. Councilmember Goldby requested staff look into the flag protocols for the correct method to display flags for use at City events and facilities. Mayor Cafagna congratulated City employee, Scott Edwards on his win of a Cadillac that had belonged to EIvis Presley at the Del Mar Fair. Mayor Cafagna provided a brief verbal update on Regional Governance Options. With City Attorney Eckis providing a written and verbal summarization of the status of critical components of the Legislation to date.
