CC 2000 02-10 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL ADJOURNED REGULAR MEETING FEBRUARY 10, 2000 The February 10, 2000, adjourned regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. The following person was present wishing to speak: Anthony Pagano, 12852 Francine Terrace, spoke regarding the High School using the field currently used for Lacrosse for future parking expansion. 6855 Page 2 - CITY OF POWAY - February 10, 2000 ITEM 1 (203-03) ZONE CHANGES OUTDOOR DISPLAYS Introduction by City Manager Bowersox. Staff report by Development Services Director Fritz. A staff report was submitted at the October 19, 1999 Council Meeting, offering several options for modifying the current regulations as they relate to outdoor display of memhandise within all commemial zones. Council directed staff to: rework the proposed guidelines to include percentages that establish the size/area/height of display merchandise; require a Minor Conditional Use Permit (MCUP) for all display requests and a Conditional Use Permit (CUP) for those businesses that go beyond the guidelines. This report addresses these items. The following people were present wishing to speak: Gail Trunnell, 13314 Neddick, spoke regarding sidewalk displays, stated she supports the proposal with exception of displays of junk. Jack Duncan, 13345 Poway Road, representing Dixieline, spoke in support of the CUP process. Fabio Gaipa, 13345 Poway Road, Dixieline Manager, spoke in support and responded to questions of the Council. ITEM 2 (203-11) DEVELOPMENT STANDARDS HILLSIDE/RIDGELINE Mayor Cafagna stated that this item was requested to be removed from the agenda and continued to a future meeting. There was no one present wishing to speak. ITEM 3 (701-04) TREE CITY USA MUNICIPAL CODE AMENDMENT Introduction by City Manager Bowersox. Staff report and presentation by Public Services Director Howell. A proposed tree ordinance, written to meet the minimum requirements for a Tree City USA designation, was before the Council on December 14, 1999. At the 6856 Page 3 - CITY OF POWAY - February 10, 2000 January 4, 2000 Second Reading, the ordinance was pulled and staff was directed to revise and clarify the ordinance and bring it back for Council review and discussion at a workshop. The primary intent of the Tree City USA designation is to demonstrate good urban tree management practices, planting the right trees in the right places. The current Poway Municipal Code provisions for tree preservation were used as a basis for this ordinance. The terms, phrases, procedures and policies have been corrected and/or clarified under the proposed ordinance. The only changes in practice and or policy would be as follows: Encroachment Permits would be required for trees to be planted on public rights-of-way; Prohibition of planting trees in public rights-of-way on residential streets and easements; Tree permit appeals; Native Tree definition; Establishment of a Poway Tree Committee. Fleischman, 15070 Pomerado, spoke in support of the Tree City USA. William P. O'Brien, 14821 High Valley Road, spoke in opposition to regulation on private property. William Culviner, 13036 Avenida La Valencia, spoke in opposition to regulation on private property. Anthony Pagano, 12852 Francine Terrace, spoke in opposition to regulation on private property.
