AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
AMENDING SAN DIEGO COUNTY ZONING ORDINANCE
ADOPTED BY REFERENCE BY THE CITY OF POWAY
ESTABLISHING CRITERIA FOR REVOCATION OF
OR MODIFICATION OF USE PERMIT
THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
Section 1. The City Council finds that the current findings
necessary to revoke or modify a Use Permit for cause are insufficient to
protect the health, safety and general welfare of the City.
Section 2. Section 7382 of the San Diego County Zoning Ordinances,
as adopted by reference by the City of Poway, is amended as follows:
(a) Delete Section 7382a3
(b) Substitute Section 7382a3 as follows:

That the use for which the permit was granted is found
to be detrimental to the public health, safety and/or
general welfare, or is so conducted as to be a
nuisance.
(c) Add section 7382a4 as follows:

That, as a result of evidence now available and not
available at the prior hearing when permit was granted
and could not have been obtained with reasonable
diligence at that hearing, the findings made, pursuant
to Zoning Ordinance Section 7358, can no longer be
made.
Introduced and first read at a regular meeting of the City Council of
the City of Poway held the 17th day of March, 1981 and thereafter PASSED
AND ADOPTED at a regular meeting of said City Council held the 24thlday of
March 1981 by the following vote:
