A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN DIEGO
TO CONTINUE TO FURNISH, WITHOUT CHARGE,
ALL SERVICES FURNISHED TO THE TERRITORY OF THE CITY OF POWAY
BY THE COUNTY OF SAN DIEGO PRIOR TO THE INCORPORATION
OF THE CITY OF POWAY FOR AN ADDITIONAL PERIOD OF TIME
WHEREAS, the City of Poway, California was incorporated on December 1,
1980, as a general law city of the State of California, and
WHEREAS, pursuant to Government Code Section 35448(a), the County of
San Diego is required to furnish, without charge, to the area incorporated
all services furnished to the area prior to the incorporation for the
remainder of the fiscal year in which incorporation became effective; and
WHEREAS, pursuant to Government Code Section 35448(b), at the request
of the legislative body of a newly incorporated city, the County Board of
Supervisors may determine to furnish county services, without charge, for
an additional period of time beyond the end of the fiscal year in which
incorporation became effective,
NOW, THEREFORE, the City Council of the City of Poway DOES RESOLVE,
DETERMINE AND REQUEST as follows:
Section 1. The Board of Supervisors of San Diego County is hereby
requested to furnish, without charge, all services the County furnished to
the area of the City of Poway prior to incorporation for an additional
period of time after the end of the fiscal year in which incorporation
became effective.
Section 2. It is further requested that said additional period of time
extend from July 1, 1981 to November 30, 1981.
Section 3. It is further resolved and requested that County provide
all such services that it provided prior to incorporation for the afore-
mentioned additional time, provided, however, that the City Council may
request discontinuance of one or more of such services prior to the expira-
tion of such additional time.
