CITY COUNCIL APPROVING
TENTATIVE ~P }~O. 4107
~IEREAS, Tentative Map No. 4107 proposing the division of property generally
described as:
Portion of Section 2, Township 14 south, Range 2 west, S.B.B.~I.
was filed with this Council pursuant to the Subdivision b]ap Act and Poway Subdi-
vision Ordinance on October 16, 1980; and
WI~REAS, the subdivider proposes to file a final map of said subdivision; and
h]tER~AS, this Council has considered said tentative map and reconm~eadations
of the Department of Planning and Land [,'se, the County Department of Public h~orks,
the Director of Park Development Division, the Director of Public Health, Envi-
ronmental Review Board and the Poway Fire Department with respect thereto and
has determined that the conditions hereinafter enumerated are necessary to insure
that the subdivision and the improvement thereof will conform to all ordinances,
plans, rules, standards and improvement and design requirements of the City of
Poway;
NOgV, THEREFORE, BE IT RESOLED that this Council hereby makes the following
findings:
The tentative map is consistent with the Poway General Plan because it pro-
poses a density of 2.3 dwelling units per acre ia~ the Residential "5" designation;

The design and improvements of the proposed subdivision are consistent with
the Poway General Plan because the Residential "5" desi~mtion promotes single
family subdivisions with parcels of 10,000 square feet or larger; and
The site is Physically suitable for the proposed density of development at
2.$ dwelling units per acre; snd
The site is physically suitable for the residential tFr~e of development pro-
posed; and
~e discharge of sewerage waste from the subdivision into the Pomerado County
Water District sewer system will not result in violation of existing requirements
prescribed by the California Regional Water quality Control Board pursuant to
Division 7 (commencing with Section 13000) of the Nater Coae as specified by
Government Code Section 66474.6; and
~e design of the subdivision or the type of improven~nts will not cause
serious public health problems because all sewage will be accommodate~ by the
Pomerado Sewer System; and

The design of the subdivision or the proposed improvements are not likely
to cause substantial environmental dmnage or substantially and avoidably injure
fish or wildlife or their habitat because all impacts will be mitigated pursuant
to the Conditional Negative Declaration; and
IT IS FO~D, DETERMINED AND DECLARED in accordance with the attached Conditional
Negative Declaration dated October 16, 1980, that TM 4107 would not have a signif-
icant effect on the environment provided the mitigating measures are complied with.

Said tentative map is hereby approved pursuant to the Poway Subdivision
Ordinance and no waiver of any requirement of said Ordinance is intended
or implied except as specifically set forth in this resolution as follows:
Waive the requirements of Section 4.1(10[bi) and 4.2(1) of the Poway Standards
which require P.C.C. curbs for all streets where any abutting lot has an area
of one-half acre or less and require P.C.C. sidewalks where any of the lots
contain 10,000 square feet or less. The waiver will apply only to Camino del
Norte (SA 680) and will allow A.C. dikes and A.C. walkways in lieu of P.C.C.
curbs and sidewalks.
/3'~e approval of this tentative map expires on January 7, 1983, at S:00 P.~.
The final map or maps conforming to this conditionally approved tentative
map shall be filed with the City Comlcil in time so that said Council may
approve the map before this approval expires unless prior to that date the
City Council subsequently grants a one-year time extension for obtaining such
approval of said final map or maps as provided by the Poway Subdivision
Ordinance.
Said tentative map of the proposed subdivision is approved subject to the
following conditions which shall be complied witi~ before a final map thereof
is approved by thc City Council m~d filed with the Co~ty Recorder of
San Diego County:
(PLANS ~qD SPECIFICATIONS)
~e subdivider shall submit plans and specifications for improvements of all
public streets, rights-of-way, drainage easements, culverts, drainage structures
and drainage channels to the County Department of Public ~orks for approval.
~less specifically waived herein, such plans and specifications shall provide
for and be subject to the following conditions lettere~ a through s:
Street alignments and grades, including the change of any existing or
proposed street alignment and grade, as required by the Director of
Public h'orks.
A drainage system capable of handling and disposing of all surface waters
originating within the subdivision ana all surface waters that may flow
onto the subdivision from adjacent lands. Said drainage system shall
include any easements and structures required by the Director of Public
Works to properly hm~dle the drainage.

The improvement of all drainage easements by culvert or drainage channel
of adequate size, whichever is required by the Director of Public Works.
Any required drainage channel shall be lined with a suitable material as
specified by the Director of Public Works. All such arainage easements
shall be monumented along property lines at locations approved by the
Director of Public Works. An access easement shall be provided to each
drainage system maintenance access point not directly accessible from
a public roadway. Such access easement to be improved, fenced and aligned
to tke satisfaction of the Director of Public Works.
The installation, if required, of all gas, electric, sewer, and water
lines and any other below surface utilities to take place before the
installation of any concrete curbs, gutters, and sidewalks, and the sur-
facing of the streets.
Portland cement concrete cross gutters to be installed where water
crosses the roadways.
The exact depth of imported base material to be based on soil tests
which have been approved by the Director of Public h'orks.
Each building lot shall have a flood-free site for a residence. The
building site shall be safe from the flood flow peak of a 100-year
frequency storm from Pomerado Creek.
An adequate energy dissipator is to be constructed at the outlet of tile
chmmel.
Hydrology and hydraulic calculations for determining the storm system
design shall be provided satisfactory to the oepartment of Public
Wo~s.
An improved channel or other storm drain facility shall be co~mected to
tile existing upstream channel (TM 3461) to carry tile peak discharge of
a 100-year frequency storm. A draJalage easement shall be provided for
this facility.
Construct a light system conforming to Poway City Standards at no
cost to the public subject to the following:
(1)
Cut-off luminaires shall be installed which will prove true
cut-off and prevent projection of light above the horizontal
from the lowest point of the lamp or light emitting refractor
or device.
(2) All fixtures shall use a clear, high pressure soditm~ vapor light
source.
(3) No mercury vapor, quartz, metal halide or diffuse coated high
pressure sodium lamps shall be installed.

Sight distance requirements at all public street intersections to conform
to the intersectional sight distance criteria as provided by the American
Association of State Highway Officials in the publication "Geometric Design
for Local Roads and Streets - 1971" or as revised.
If the improvement plans show a need to excavate in any public road
right-of-way, the developer shall place a cash deposit with the
Director of Public Works.to insure that any damage to the existing
roadway is repaired in a timely manner.
Improve Camino del Notre (SA 680) from the westerly boundary of Lot 1
to Pomerado Road to a minimum graded width of 40 feet with 28 feet of
A.C. pavement over approved base with A.£. dikes at 14 feet from center-
line. The improvement shall include necessary drainage structures.
The developer may at his option augment tile minimmn described in~rove-
ments for the westerly extension of Camh~o del ~orte (SA 680) to Pomerado
Road by improvement of a graded width of 13i feet (126 feet where the
dedication of a riding and hiking trail is not required) with 2g feet of
A.C. pavement over approved base with A.C. dikes at 14 feet from center-
line or with 64 feet of A.C. pavement over approved base with P.C.C.
curb and gutter with the curb at 32 feet from centerline. A sidewalk
may be constructed at a location within the area to be dedicated to the
satisfaction of the Director, Department of Public Works. Bonding shall
only be required for 28 feet of pavement and a 40 foot graded width.
The improvements shall include necessary drainage structures.
Improve the southwesterly one-half of Cmaino del Norte (SA 680) adjacent
to Lots 1 and 10 to a graded width of 68 feet (63 feet if the dedication
of a riding and hiking trail is not required) with 32 feet of A.C.
pavement over approved base with P.C.C. curb, gutter and sidewalk with
curb at 32 feet from centerline. The improvement shall include a sigmed
and striped bicycle lane within a "No Parking" area. A.C. dikes and
A.C. sidewalks may be ~ubstituted for P.C.C. curb, gutter and sidewalk
if the City Council waives the approvriate sections of the City
Standards. The sidewalk shall be constructed at a location within the
area to be dedicated to the satisfaction of the Director, Department of
Public Works.
Improve the northeasterly one-half of Camino del Norte (SA 680) to a
minimum graded width of 20 feet with 14 feet of A.C. pavement over
approved base with A.C. dikes at 14 feet from centerline. The improve-
ment shall include necessary drainage structures. The developer may at
his option augment the minimum described improvement for tile westerly
extensi~ of Camino del Norte (SA 680) to Pomerado Road by improvement
of a graded width of 68 feet (65 feet if the dedication of a riaing and
hiking trail is not required), with 14 feet of A.C. pavement over approved
base with A.C. dikes at 14 feet from the cent,flirt, or with 32 feet of
A.C. pavement over approved base with P.C.C. curb and gutter with the
curb at 32 feet from centerline. A sidewalk may be constructed at a
location within the area to be dedicated to the satisfaction of the
Director, Department of Public Norks. Bonding shall only be required
for 14 feet of pavement and a 20 foot graded width. The improvement shall
include necessary drainage structures.

Improve the Riding and }liking Trail System to the following design stan-
dards to the satisfaction of the Director, Department of Public Works:
(1) The trail shall contain a minimum eight feet of tread width
with drainage structures as necessary.
Thc trail surface shall consist of the native soil, or wkere the
soil is highly erosive or will not support tim traffic, a tread
surfacing material such as decomposed granite which will blend
with the natural environment shall be provided.
(3)
Trail gradients shall not exceed 15%. }~ere natural grades exceed
15% sufficient width for switchbacks shall be provided to acco~mnodate
a 15% gradient trail.
Trails shall intersect roads at approximately 90° angles.
(5) ~e trail system shall be continuous through the subdivision and
shall provide for local access witMn the subdivision.
(6) Points where the trail exits the subdivision shall be coordinated
with existing or planned trail locations on adjacent property.
(7) Signs at trail entrances to provide identification, rules and regu-
lations; and markers along the route to air, ct the users.
Unless specifically waived herein, the City of Powa¥ Standards shall
apply in preparing i~rovement plans irrespective of what is shown on
the approved tentative map.
Construct, or agree to construct, the public improvements shown on the
improvement plans as approved by the Director of Public Works.
(GRADING P LPuNS)
2. Prior to the issuance of a grading permRt the subdivider shall comply with
the following conditions lettered a through e:
The subdivider shall submit grading plans and grading pemait application
mtd all grading permit fees and deposits to the Count7 Department of
Public ~orks. Grading plans shall be approved prior to or concurrently
with the approval of the Improvement Plans.
The grading plan shall contain a certificate signed by a registered
civil engineer that the grading plan has preserved a minimum of 100
square feet of solar access for each dwelling unit and for each future
building site within the subdivision.

No grading shall be permitted within this subdivision until the subdi-
vider obtains sewer commitmeut from the Pomerado County Water District.

The subdivider shall deposit with the Comity Department of Public ~orks
$200.00 at the time the Lot Grading Plan or Improvement Plan is sub-
mitted. The deposit will be made with whichever plan is first submitted.
Said deposit shall be used to cover the cost of site inspection by a
County Geologist to determhm whether or not any geologic hazard exists
and, if such is found, to review the geologic report prepared by the
Developer's Engineering Geologist. The developer shall reimburse the
County Department of Public Works for m~y cost in excess of the deposit
prior to recording the Final blap. Any unused portion of the deposit
will be refunded.
~e applicant shall submit a landscape plan for the disturbed slope
areas that incorporates drought resistant, non-invasive species. This
plan shall be to tixe satisfaction of the birector, Department of
Public l/orks. (CND)

Obtain the commitment of the Pomerado Comity ~ater District to connect all
lots within the subdivision to its public sewer system and obtain the
consent of said District of the plans and specifications for the installation
of a sewer system serving east lot within the subdivision.
(FIRE PROTECTION)
St~mit a letter from the Poway Fire Department stating satisfaction with the
type and location of fire hydrants and the minimum available water flow in
gallons per minute together with a certification from the Poway Water District
or agency certifying that the fire department's minimum water flow is avail-
able to serve the site.

A note shall appear on the face of the Final Map indicating that all
lots within this subdivision have solar access as required by Section
81.401(n) of the Subdivision Ordinance.

Dedicate all on-site drainage easements, including easements for
access thereto, and show monumentation for such easements, as required
by the Director of Public Works.
c. No lot shall contain a net area of less than 10,000 square feet.
The applicant shall submit a copy of the Preliminary Soils mm Geologic
Report, to the Director of Public Works. (Upon application for a grad-
ing permit for parcels on this map, the Department of Public l~orks will
review the report and implement appropriate recommendations.) (CND)

6.
The applicant shall design and show on the grading plan a solid continuous
noise attenuation barriers between Lots 1 and 10, and Camino del Notre to
the satisfaction of the Environmental ~lalysis Coordinator.
Tile noise attenuation barrier may consist of an earth berm topped by a
free standing wall of any material having a surface density not less
than 5.S pounds per square foot and shall have a total height not less
than eight feet above the building pad elevation for Lot 1, mid shall
have a total height not less than seven feet above the roadway elevation
for Lot 10.
This barrier or equivalent shall be secured by both a cash deposit and
right-of-entry to the satisfaction of the Director of Public Works. [CND)
The applicant shall construct flood control improvements, if necessary,
to the satisfaction of the ~epartment of Public Works. (CND)
The dedication of an additional five feet on each side and adjacent to
Camino del Norte as a riding and hiking trail. If a proposal for an
alternate east-west trail northerly of Camino del Notre is acceptable
to Director, Department of Public [torks, the alternate trail may be
dedicated in lieu of tile trail required on the northerly side of Camino
del Norte.
Dedicate Camino del Norte {SA 650) from the westerly bomldary of Lot 1
to Pomerado Road to a m~imum width of 60 feet. The developer may at
his option dedicate this portion to a width of 126 feet. Recordation
data for off-site portions shall be shown on the final map.
Dedicate the northeasterly one-hail of Camino del Norte (SA 680) to a
minimmn width of 30 feet. The developer may at his option dedicate
this portion to a width of 65 feet. Recordation data for off-site
portions shall be shown on the final map.
The 100-year flood line of tile natural channels crossing all lots, and
draining watersheds in excess of 25 acres, shall be clearly delineated
on the final map.
Tha final map shall include the entire area shown on the tentative ~nap
and shall not be filed as units; lot numbering and desig~ on final map
shall be in substantial conformance to that shown on the tentative map.
The subdivider shall accomplish the following lettered a through k:
The subdivider shall grant to the appropriate agency by recorded
document all required off-site easements and all on-site water main
easements that serve fire hydrants.

The subdivider shall deposit with the County of San Diego, through
the County Department of Public Works, in care of the Community
Services Agency cashier, a cash deposit sufficient to:
Energize, maintain and operate the street lighting system until
tax revenues begin accruing from the subdivision for those
purposes.
(2)
Augment the Contingency Fund of the existing District Oy an
amount equal to three months' operating cost of the subdivision.
(5) Augment the Reserve Fund by one month's operating cost.
(4)
Pay the cost of annexation to an appropriate special district
including the cost of processing through the State Board of
Equalization. After recording of the final map, the subdivi-
sion shall be annexed without notice or hearing, to an existing
special district to operate an~ maintain the system.
Tile subdivider shall install or agree to install a sewer system as
a subdivision improve~mnt and dedicate to the public that portion
of such system which is within an existing or proposed public right-
of-way.
Streets shown on the tentative map to be given street names approved
by the Street Address Section of the Department of Planning and Land
Use and the subdivider shall install all street name siins a~ a part
of the subdivision street is~rova~ents.
Tke subdivider shall dedicate the 38 acre park site generally outlined in
Sheet 2 of TM $49SR; said dedication fulfilling 100% of the Park Lands
Dedication Ordinance required for TM 349SR and each subsequent unit of the
project. Grading plans shall be approved by the Parks and Recreation
Department and streets and utilities shall be brought to the park site
at the time the adjacent areas are developed.
All new and existing utility distribution facilities, including cable
television lines, within the boundaries of any ne~ subdivision or within
any halff street abutting a new subdivision shall be placed underground.
The subdivider is responsible for complyin2 with the requirements of
this condition, and he/she shall make the necessary arrangements witl~
each of the serving utilities, includin~ licensed cable television
operators, for the installation of such facilities, When the installation
of cable television lines is required, the subdivider shall either
provide the Director o£ Public Works with documentation from a licensed
cable television operator stating arrangements for the underground
installation of cable television lines have been made, or the subdivider
shall provide the Director of Public Works with docm~entation titat the
Cable Television Review Commission has reported that no licensed cable
television operator is willing and able to install cable television lines
in the subdivision.

The subdivider shall comply with Section 06436 of the Government Code
by furnishing to ti~e County Department of Public ;Vorks a certification
from each public utility and each public entity owning easements within
the proposed subdivision stating that: (a) they have received from the
developer a copy of the proposed final map; (b) they object or do not
object to the filing of the map without their signature; (c} in the case
of a street dedication affected by their existing easement, they will
sign a "subordination certificate" or "joint-use certificate" on the
ma~ when required by the governing body. In addition the subdivider
shall furnish proof to the satisfaction of the Director, Department of
Public ~orks, that no new encumbrances have been created that would sub-
ordinate the County's interest over areas to be dedicatea for public
road purposes since submittal of the tentative map.
The developer shall participate in the cost of a traffic signal installa-
tion at the intersection of Pomerado Road (SA 670) and Camino del Notre.
The amount of the developer's portion of the entire cost of the signal
shall be $220.00.
The developer shall place a $3,434.00 deposit in the Community Services
Trust ~und for the improvement of future Circulation Element roads and
bridges in the Poway Area No. S. (CND) A credit for construction in
excess of the local interst portion of SA 680 will be applied against
this deposit.
A legal entity shall be formed for the maintenance of landscaping along
the Camino del Norte right-of-way and appurtenant cut slopes. Until such
legal entity is formed, the developer shall be responsible for said main-
tenance.
The subdivider shall secure recertificatioms satisfactory to the Director
of Public ~orks of availability of adequate public services and utilities
including but not necessarily limited to: fire, water and sewer services
to the site, said recertifications dated within 00 days prior to City
Council~ approving final map.
This approval is further conditioned by the following instructions to staff:
a. This is a solar subdivision. Ail lots within this subdivision shall
have a minimum of 100 square feet of solar access for each lot pursuant
to Section $1.401(n) of the Subdivision Ordinance.
b. This subdivision has been approved for public sewer. If the sewer
con~itment terminates before connection to sewer and prior to the
City Council's final map approval, the Department of llealth Services
will deny application(sO for individual subsurface sewage disposal
syst~a(s) within this subdivision, unless a Resolution Araendment
has been obtained from the City Council ~hich approves individual
subsurface sewage disposal systems for this subdivision.
The protection of the public interest requires that the subdivider, contractors,
builders, lot or parcel owners, and other ~ersons, firms and corporations
conce~ed with the development of said subdivision conform to the following
standards, and all permits required by the City of Poway will be issued pur-
suant to such standards:

All domestic water supplied for this subdivision shall come from the
Poway M~a~icipal Water District.
All buildings constructed in this subdivision shall be connected to
the public sewer system of the Pomerado County [rater District.
Sewer and water lines shall not be laid in the same trench in any part
of this subdivision.
Proper drainage shall be maintained throughout this subdivision so as
to prevent ponding and/or storage of surface water that would create a
public health hazard or nuism~ce.

On January 7, 1981, the Poway City Council adopted
the attached Resolution of Approval on your tentative map
application, by a vote of 5-o.
The decision of the City Council is final, and there is
no appeal.

hereby certify that I have compared the attached copy with
the original Resolution passed and adopted by the City
Council of the City of Poway at a regular meeting thereof;
