AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE ZONING PLAN MAP OF THE ADOPTED SOUTH
POWAY PLANNED COMMUNITY DEVELOPMENT PLAN
FOR CERTAIN PROPERTY (ZC 87-04)
WHEREAS, the City Council approved the South Poway Planned
Community Development Plan on July 30, 1985 and said Development
Plan is a component of the Poway General Plan and is intended to
serve as the specific plan for the South Poway area; and
WHEREAS, the City Council of the City of Poway on December 22,
1987, approved an amendment to the land use map of the South Poway
Planned Community Development Plan (GPA 87-03) for portions of
assessor's parcels 320-011-01, 320-011-02, and a portion of
320-011-03 located at the southwest corner of the future intersec-
tion of the new Pomerado Road and the South Poway Parkway; and
WHEREAS, the subject approved amendment involved a staff-
prepared alternative to the application filed by McMillin Financial
Development, Inc. (GPA/ZC 87-04); and
WHEREAS, the approved alternative amendment redesignated the
land use for approximately 6.65 net acres located at the southwest
corner of said future intersection from Rural Residential A
(1 du/4, 8, 20, or 40 net acres) to South Poway Commercial and
modified the previously approved total number of residential units
within the Residential Single Family 2 and Rural Residential A land
use designations from 63 to 105 units total; and
WHEREAS, the City Council finds that the zoning plan map of the
said Planned Community Development Plan should also be changed to
maintain consistency with the General Plan as required by Section
65860 of the California Government Code; and
WHEREAS, the City of Poway held a properly noticed public
hearing in accordance with the California Government Code and the
California Environmental Quality Act to consider this zoning rede-
signation; and
WHEREAS, the City Council has considered the EIR addendum pre-
pared for the proposed amendment along with the Final EIR for the
South Poway Plan and has determined that the addendum makes the
original EIR adequate for this proposed zoning redesignation; and
WHEREAS, the City Council finds that this zoning redesignation
is consistent with the policies and objectives of the Poway General
Plan regarding the South Poway area, is in conformance with the
intent, policies, objectives, and standards of the adopted South
Poway Planned Community Development Plan, would not result in a

significant increase in environmental effects for the South Poway
area as identified in the Final EIR for South Poway and in the EIR
addendum prepared for the subject site, and is in substantial
compliance with the findings made under Resolution No. 85-44 which
enacted the South Poway Planned community Development Plan, as
prescribed by the Planned community regulations of the Poway
Municipal Code (Zoning Development Code); and
WHEREAS, the City Council further finds that the above men-
tioned final EIR and addendum adequately fulfill the CEQA require-
ments for this zone change and hereby issues a Mitigated Negative
Declaration.
NOW, THEREFORE, BE IT ORDAINED that the City Council of the
City of Poway does hereby amend the zoning plan map of the South
Poway Planned Community Development Plan for the subject parcels of
land as described above.
EFFECTIVE DATE: This ordinance shall take effect and be in
force thirty (30) days after the date of its passage; and
before the expiration of fifteen (15) days after its passage,
it shall be published once with the names and members voting
for and against the same in the Poway News chieftain, a
newspaper of general circulation published in the City of
Poway.
Introduced and first read at a regular meeting of the City
Council of the City of Poway held the 22nd of December, 1987, and
thereafter PASSED AND ADOPTED at a regular meeting of said City
Council held the 5th day of January , 198~ by the
following roll call vote:
