Res 10-040RESOLUTION NO. 10 - 040 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL RECALL ELECTION HELD IN SAID CITY ON JUNE 8, 2010, DECLARING THE RESULTS THEREOF AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a Special Municipal Recall Election was held and conducted in the City of Poway, California, on Tuesday, June 8, 2010, as required by law; and WHEREAS, the City Council of the City of Poway, California, by Resolution No. 10- 011, adopted on February 16, 2010, did cause to be Noticed to the qualified electors of the City, a Special Municipal Recall Election to be held in the City of Poway on the 8' day of June, 2010 for the recall of Councilmember Betty Rexford and the election of a successor if the recall prevailed. WHEREAS, notice of the election was given in time, form and manner as prescribed by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections code of the State of California, for the holding of elections in general law cities; and WHEREAS, the City's vendor, the Registrar of Voters of the County of San Diego, has canvassed the returns of the election and the City Clerk has certified the results as attached hereto made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That the Special Municipal Recall Election was held for the purpose of submitting to the voters of the City the following question: Shall Betty Rexford be recalled (removed) from the office of Member of the City Council? YES NO For Member of the City Council to succeed Councilmember Betty Rexford if she is recalled (Term Ending November, 2010) (Followed by the list of candidates for this office and a line for q ualified write -in candidates Section 2. That the whole number of ballots cast in the City was 12,064 ballots. Resolution No. 10-040 Page 2 Section 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates, were as listed in "Exhibit A" attached. Section 4 . That the City Council does declare and determine that as a result of the election, a majority of the voters voting on the measure relating to the recall of Betty Rexford did vote in favor thereof, and that Betty Rexford is recalled from the Office of Member of the City Council in the City of Poway. Section 5. That the names of the persons voted for at the election for Member of the City Council to succeed Betty Rexford, term ending November 2010, and votes cast are as follows: John Mullin Steve Vaus Pete Babich Dave Grosch Chuck Cross David Radcliff Roger Willoughby Howard Collins Receiving 3,152 Votes Receiving 3,049 Votes Receiving 2,026 Votes Receiving 1214 Votes Receiving 709 Votes Receiving 618 Votes Receiving 377 Votes Receiving 238 Votes Section 6. The City Council does declare and determine that: John Mullin was elected as Member of the City Council for a term ending November 2010. Section 7. The City Clerk shall enter on the records of the City Council of the City of Poway, a statement of the result of said election, showing: 1. The whole number of votes cast in the City. 2. The names of the persons voted for. 3. For what office each person was voted. 4. The number of votes given at each precinct to each person. 5. The number of votes given in the City to each person. Section 8. That the City Clerk shall immediately make and deliver to the person elected, a Certificate of Election signed by the City Clerk and authenticated, that the City Clerk shall also administer to the person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. Whereupon, each person so elected shall then be inducted into the respective office to which they have been elected. Section 9. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions.
