A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
VACATING CERTAIN RIGHT-OF-WAY FOR CITY HIGHWAY
WHEREAS, Subdivision (b) of Section 8324 of the Streets and
Highways Code provides that the legislative body may adopt a resolution
vacating any street, highway or public service easement; and
WHEREAS, on February 3, 1981, the City Council adopted
Resolution No. 71 declaring its intention to vacate and abandon an
easement for City Highway; and
WHEREAS, the matter came on for hearing before the City Council
of the City of Poway, State of California, this 3rd day of March 1981 at
7:00 P.M., and evidence being on file that due and proper notice of said
hearing has been given as required by law; and
WHEREAS, the Department of Planning and Land Use, in its report
filed in the office of the Clerk of the City of Poway on February 23,
1981, recommended that the City Council approve the vacation requested by
the Department of Transportation;
NOW THEREFORE IT IS RESOLVED AND ORDERED that the hearing be and
it is hereby closed; that the subject right-of-way is not useful as a non-
motorized transportation facility and that the proposal is not subject to
the environmental review process; and
BE IT FURTHER RESOLVED that the City Council does hereby vacate
and abandon the hereinafter described City highway pursuant to the
procedures prescribed by Chapter 3 (commencing with Section 8320), part 3,
Division 9 of the Streets and Highways Code.

That portion of the Southerly 190.00 feet of the Northerly 250.00 feet
of Section 31, Township 13 South, Range 1 West, San Bernardino Meridian
in the County of San Diego, State of California, lying Westerly of a
line that is 30.00 feet Westerly of and parallel and concentric with
the centerline of Espola Raod as shown on Road Survey 335, said Road
Survey being filed in the Office of the County Engineer of said County,
said centerline being described as follows:
BEGINNING at Centerline Station 216+93.65 of said Road Survey 335; thence
Northerly along said centerline the following courses: North 04o41' West,
820.86 feet to the beginning of a tangent lO00.O0 foot radius curve con-
cave Easterly; thence Northerly along the arc of said curve, through a
central angle of 12o12' a distance of 212.93 feet; thence tangent to said
curve North 07o31' East a distance of 108.31 feet to the beginning of a
tangent lO00.O0 foot radius curve concave Westerly; thence Northerly along
the arc of said curve through a central angle of 07o33'30'' a distance of
131.92 feet to a POINT OF TERI~INUS.

RESERVING AND EXCEPTING from vacation and abandonment easements and rights pursuant
to any existing franchise or renewals thereof, or otherwise, at any time, or from
time to time, to construct, maintain, operate, replace, remove, renew and enlarge.
lines of pipe, conduits, cables, wires, poles and other structures, equipment and
fixtures for the operation of gas pipe lines, telegraphic and telephone lines and
for the transportation or distribution of electrical energy and water and for inci-
dental purposes including access to protect the property from all hazards in, upon,
over and across the above described portions of highways proposed to be vacated
and abandoned; and
RESERVING AND EXCEPTING from vacation and abandonment easements and rights at any
time and from time to time to construct, maintain, operate, replace, remove and
renew sanitary sewers, storm drains and appurtenant structures including access
to protect the property from all hazards in, upon, over and across the above
described portions of highways proposed to be vacated and abandoned.
PASSED AND ADOPTED by the City Council of the City of Poway,
California at a regular meeting thereof this 3rd day of March 1981.
