AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
ADDING SECTIONS 6.20.040 AND
6.20.050 TO THE POWAY MUNICIPAL CODE
REGARDING PROHIBITING THE USE
OF STEEL-JAWED LEG-HOLD TRAPS
WHEREAS, the steel-jawed leg-hold trap is nonselective, being indiscriminate
in what it snares, and persons, domestic and other nontargeted animals have been
caught in said traps; and
WHEREAS, the prohibition of the use and placement of the steel-jawed leg-
hold trap is necessary to protect the public health and safety; and
WHEREAS, such prohibition only incidentally affects the field of hunting
preempted by the State Fish and Game Code; and
WHEREAS, the City Council finds that this ordinance is Categorically Exempt
under Class 8 of the C.E.Q.A. Guidelines.
NOW, THEREFORE, the City Council of the City of Poway, California does
ordain as follows:
Section 1. Sections 6.20.040 and 6.20.050 are hereby added to the Poway
Municipal Code to provide as follows:
6.20.040 Use of Steel-Jawed Traps Prohibited
Except as expressly provided in this chapter, it shall be unlawful for any
person to set, trigger, activate of otherwise use, or cause to be set,
triggered, activated or used any steel-jawed animal leg-hold trap.
6.20.050 Excepted Use of Steel-Jawed Traps
Nothing in this chapter shall prohibit any governmental agency from using or
causing to be used any steel-jawed animal leg-hold trap, provided that
written notice of the intended location and dates of use is first provided
by such agency to the City.
Section 2. This ordinance shall take effect and be in force thirty {30}
days after the date of its passage; and before the expiration of fifteen {15)
days after its passage, it shall be published once with the names and members
voting for and against the same in the Poway News Chieftain, a newspaper of
general circulation published in the City of Poway.

Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 15th day of March, 1988, and thereafter PASSED AND
ADOPTED at a regular meeting of said City Council held the 22nd day of March,
1988, by the following roll call vote:
