A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
REQUESTING THAT THE SAN DIEGO COUNTY BOARD OF SUPERVISORS
ANNEX THE TERRITORY IN SAN DIEGO COUNTY LIGHTING
MAINTENANCE DISTRICTS NO. 2 AND NO. 3 THAT IS ALSO
WITHIN THE CITY OF POWAY TO SAN DIEGO COUNTY
LIGHTING MAINTENANCE DISTRICT NO. 1
WHEREAS, street lighting services in the unincorporated area are provided
through the special districts, San Diego County Lighting Maintenance Districts
No. 1, No. 2 and No. 3; and
WHEREAS, on April 29, 1980 the three County Lighting Districts held a
financing election to give the San Diego County Board of Supervisors the
authority to levy benefit charge assessments therein; and
WHEREAS, the ballot measure in San Diego County Lighting Maintenance
District No. 1 passed and the ballot measures in San Diego County Lighting
Maintenance Districts No. 2 and No. 3 failed. The failure of the financing
elections in the two Lighting Districts has caused all street lights, except
those at intersections, to be deenergized; and
WHEREAS, the City of Poway was incorporated on December 1, 1980; and
WHEREAS, the City of Poway desires to reenergize all the street lights that
were deenergized as a result of the failure of the financing election in the
two districts; and
WHEREAS, a majority of registered voters, voting in the three Lighting
District financing elections, within the City of Poway favored paying
assessments for street lights;
NOW THEREFORE BE IT RESOLVED, that
The City Council hereby requests that the San Diego County Board
of Supervisors annex all the territory that is in San Diego
County Lighting Maintenance Districts No. 2 and No. 3 and in the
City of Poway, to San Diego County Lighting Maintenance District
No. 1.
As required in Streets and Highways Code Section 5837 the City
council hereby consents to the annexation of the said territory
in the City of Poway to San Diego County Lighting Maintenance
District No. 1.

The City Council hereby requests that, after the said territory
has been annexed to San Diego County Lighting Maintenance
District No. 1, the San Diego County Board of Supervisors
withdraw said territory from San Diego County Lighting
Maintenance Districts No. 2 and No. 3.
PASSED AND ADOPTED by the City Council of the City of Poway, California at
a regular meeting thereof this 17th day of March, 1981.
