WHEREAS, Tentative Map No. 3929 proposing the division of property
generally described as:
A portion of Section 12 and 13, T.14S., R.2W., S.B.M. ~
was filed with this Ccmm!tc!c.q Council pursuant to the Subdivision Map Act and
S:n Die~o £c~n~' Poway City Sub~n Ordinance on March 29, 1979; and
WHEREAS, the subdivider proposes to file a final map of said subdivision;
and
WHEREAS, this Ccmmissicn Council has considered said tentative map and
recommendations of the Department o~--Planning and Land Use, the County
Department of ~Public Works, the Director of Park Development
Division, the Director of Public Health, +k^ n~^~^- ~ ~ n .... ~-^.~ ~
S:nit~tion :nd Flccd Ccntrc!, Environmental Review Board and the Poway Fire
Department, Poway Unified School District and the Poway Planning Group with
respect thereto and has determined that the conditions hereinafter enumerated
are necessary to insure that the Subdivision and the improvement thereof will
conform to all ordinances, plans, rules, standards and improvement and design
requirements of S:n Di~g~ Caunty-the City of Poway:
WHEREAS, the P!znning Cemm!ssie? City Council has considered and approved
a Planned Development Permit (P79-16) in conjunction with this tentative map
and found that the proposed usage made it impractical to conform fully to the
Design/Dedication/Improvement standards and requirements of the Ccunty-City
Subdivision Ordinance; and
** NOW, THEREFORE, BE IT RESOLVED that this Co~..~m..iccion Council hereby makes the
following findings:
The tentative map is consistent with the Poway Cem~?ity General Plan
because it proposes a residentiall subdivision conforming to the~
Residential 8 land use designation; and

The design and improvements of the proposed subdivision are consistent
with the Poway gemmu~ General Ilan which allows planned developments in this
land use designation; and
The site is physically suitable for the residential type of development
because surrounding land uses have been similarly developed; and
The site is physically suitable for the proposed density of development
because it is relatively level; and
The design of the subdivision or the type of improvements will not cause
serious public health problems because it will be connected to a public sewer
system; and
The design of the subdivision or the proposed improvements are not likely
to cause substantial environmental damage or substantially and avoidably
injure fish or wildlife or their habitat; and
The design of the subdivision or the type of improvements do not conflict
with easements, acquired by the public at large, for access through, or use of
property within the proposed subdivision, as defined under Section 66474 of the
Government Code, State of California; and
IT IS FOUND, DETERMINED AND DECLARED in accordance with the attached Negative
Declaration dated March 29, 1979 that TM 3929 would not have a significant
effect on the environment.

A.
THEREFORE, BE IT FURTHER RESOLVED, DETERMINED AND ORDERED as follows:
Said tentative map is hereby approved pursuant to the ~:nty~ Poway
Subdivision Ordinance and no waiver of any requirement of said Ordinance
is intended or implied except as specifically set forth in P79-16.
The approval of this tentative map expires on January 20, I~1-1982 at
5:00 p.m. The final map or maps conforming to this conditionally approved
tentative map shall be filed with the 9:=rd ~f S:2:r¥is:r: City Council in
time so that 9~=rd Council may approve the map before this approval
expires unless prior to that date the ~!:.q.qin; £~mmi::i~n :r 9:=rd ef
~Council subsequently grants a one-year time extension for
obtaining such approval of said final map or maps, as provided by the
~ ~ Poway Subdivision Ordinance.

Said tentative map of the proposed subdivision is approved subject to the
following conditions which shall be complied with a final map thereof is
approved by the Bc:rd of £:~crvi:cr: City Council and filed with the
County Recorder of San Diego County:
(PLANS AND SPECIFICATIONS)
** 1.
The subdivider shall submit plans and specifications for improvements
of all public streets, rights-of-way, drainage easements, culverts,
drainage structures and drainage channels to the County Department of
Tr:ns2crt:ticn Public Works for approval. Such plans and
specifications shall provide for and be subject to the following
conditions numbered 2 through 22 24:

The street alignment and grade, including the change of any existing
or proposed street alignment and grade, as required by the Director
of ~ ....... ~.~A~ Public Works.

A drainage system capable of handling and disposing of all surface
waters originating within the subdivision and all surface waters that
may flow onto the subdivision from adjacent lands. Said drainage
system shall include any easements and structures required by the
Director of ~ ....... ~^~ Public Works to property handle the
drainage.
** 4.
The improvement of all drainage easements by culvert or drainage
channel of any adequate size, whichever is required by the Director of
the Department of v,,_.~.*~^"._..~.. Public Works. Any required drainage
channel shall be lined with a suitable material as specified by the

drainage easements shall be monumented along property lines at
locations approved by the Director of the Department of
-~i~q~Public Works. An access easement shall be provided toy
each drainage system maintenance access point not directl accessible
from a public roadway. Such access easement to be improved, fenced
and aligned to the satisfaction of the Director of the Department of
Transportation Public Works.
The installation of all, gas, electric, sewer, and water lines and
any other below surface utilities to take place before the
installation of any concrete curbs, gutters, and sidewalks, and the
surfacing of the streets.
Portland cement concrete cross gutters to be installed where water
crosses the roadways.
** 7.
The exact depth of imported base material to be based on soil tests
which have been approved by the Director of the Department of

Streets shown on the tentative map to be given street names approved
by the Street Address Section of the Department of Planning and Land
Use and the subdivider shall install all street name signs as a part
of the subdivision street improvements.

A street lighting system conforming to,an n~A.A_..~v £Cur~t~ Poway City
standards to be shown and to be installed at no cost to the public.
All lighting devices, or combinations thereof, on a common fixture
that are to be placed in the public right-of-way are subject to the
following conditions:
Cut-off luminaires shall be installed which will provide true
ninety degree (90%) cutoff and prevent projection of light above
the horizontal from the lowest point of the lamp or light
emitting refractor or device.
b. All fixtures shall use a clear, high pressure sodium vapor light
source.
c. No mercury vapor, quartz, metal halide or phosphor coated high
pressure sodium lamps shall be installed.
Sight distance requirements at all public street intersections to
conform to the intersectional sight distance criteria as provided by
the American Association of State Highway Officials in the
publication "Geometric Design for Local Roads and Streets - 1971" or
as revised.
If the improvement plans show a need to excavate in any public road
right-of-way, the developer shall place a cash deposit with the
Director of ~Public Works to insure that any damage to
the existing roadway is repaired in a timely manner.
Finished grading shall be certified by a registered Civil Engineer
and inspected by the County Engineer for drainage clearance prior to
occupancy. (Approval of the rough grading does not certify finished
grading because of potential surface drainage problems that may be
created by landscaping accomplished after rough grading
certification). If a grading permit is not required for the
~4~i4~site, a registered Civil Engineer's certification for the
drainage clearance shall still be required.
Private road structural section shall be minimum of 2" of asphalt
concrete over 4" of approved base. Grades shall be minimum of .5%
and a maximum of 15% and designed to drain the surface water
properly. Adequacy of the structural section and surface drainage
shall be inspected and certified by the County Engineer prior to
occupancy.
Property owner shall agree to preserve and save harmless the County
of San Diego and City of Poway and each officer and employee thereof
from any liability or responsibility for ancy accident, loss or
damage to persons or property, happening or occurring as the
proximate result of any of the work undertaken to complete this work,
and that all of said liabilities are hereby assumed by the property
owner.

In lieu of dedicating and improving the additional 6 feet for a
bicycle path adjacent to the west right-of-way of Midland Road, the
developer may request a waiver of this requirement from the ~card
Supcrvis:r: City Council. Such a request should include a basis of
at least one of the following findings:

This bicycle path would not serve independently as a segment
within the regional or community bicycle network.
This bicycle path would not be expected to interconnect with a
similar facility within the life of the current General Plan.
Extreme hardship due to the perculiar or unique geographic
characteristics of this parcel preclude the reasonable
development of a bicycle path.
If the ~$ard tf Su~or¥isers. City Council approves this waiver, a
bicycle lane may be substituted in lieu of the bicycle path requiring
an additional right-of-way of 4 feet (total 46 feet). This may also
require an additional 4 feet of paving for a combination parking and
bicycle lane. In the event the ~card Council does not waive the
bicycle path requirement, the developer shall improve the additional
6 feet of right-of-way as specified.
Unless specifically waived herein, the fan giege Cc:nty Poway City
standards shall apply in preparing improvement plans irrespective of
what is shown on the approved tentative map.
Each building site shall have a flood-free site for a residence. The
building site shall be safe from the flood flow peak of a lO0-year
frequency storm.
Hydrology and hydraulic calculations for determining the storm system
design shall be provided satisfactory to the Department of Sanitation
and F!ced Centre!Public Works.

The subdivider shall contribute $530 per dwelling unit to the-$a~-B~e§e--

his/her share of future area flood control/drainage improvements.

Final map shall show a 20 foot wide fire access route at the
southwest corner of the site to connect with the future cul-de-sac,
said access way to contain break-away gates which can be used by fire
fighting personnel and equipment.
Construct, or agree to construct, the public improvements shown on
the improvement plans as approved by the Director of
Public Works.
The subdivider shall submit grading plans and grading permit
application to the County Department of Tr:ns2~rtaticn Public Works.
Grading plans shall be approved prior to or concurrently with the
approval of the Improvement Plans. All grading permit fees and
deposits shall be paid and all actions necessary preceding the
issuance of the grading permit shall be completed prior to recording
the final map.
Prior to the issuance of a grading permit the subdivider shall comply
with the following conditions lettered a through d:

fair housing marketing plan.

Obtain the commitment of the Pomerado County Water District to
connect all dwelling units within the property within the subdivision
to its public sewer system and obtain the consent of said District of
the plans and specifications for the installation of a sewer system
serving each lot within the subdivision and shall install or agree to
install said sewer system as a subdivision improvement and dedicate
to the public that portion of such system which is within an existing
or proposed public right-of-way.
(FIRE PROTECTION)
Submit a letter from the Poway Fire Department stating satisfaction
with the type and location of fire hydrants and the minimum water
supply pipe size.

A certification regarding condominium conditions which shall conform
to wording by ~the City Attorney indicating that there
will be a maximum of 60 dwelling units constructed.
There shall be granted to the £c:nty City on the final map an open
space easement over the common areas. Said open space easement shall
be approved as to form by ~the City Attorney and shall
limit the uses within the easement to landscaping and recreation
purposes, including buildings, structures and improvements as
approved by Planned Development Permit P79-16 and subsequent permits
or modifications that may be under provisions of the Zoning
Ordinance.
The final map shall include the entire area shown on the tentative
map and shall not be filed as units; lot numbering and design on the
final map shall be in substantial conformance to that shown on the
tentative map.
On the final map dedicate all on-site drainage easements, including
access easements thereto, and show monumentation for such easements,
as required by the Director of ~Public Works.
The developer shall offer for dedication a 1/4 County Standard cul-
de-sac, plus slope rights, in the southwest corner of the subdivision
for future Apache Road.
The subdivider shall accomplish the following numbered-3~33 through

The subdivider shall grant to the appropriate agency by recorded
document all required off-site easements and all on-site water main
easements that serve fire hydrants.
The subdivider shall deposit with the County of San Diego, through
the County Department of ~.,.,.~v,~*~^"wv.v- Public Works, in care of the
Community Services Agency cashier, a cash deposit sufficient to:
Energize, maintain and operate the street lighting system until
tax revenues begin accruing from the subdivision for those
purposes.
b. Augment the Contingency Fund of the existing District by an
amount equal to three months' operating cost of the subdivision.
c. Augment the Reserve Fund by one month's operating cost.

Pay the cost of annexation to an appropriate special district
including the cost of processing throught the State Board of
Equalization. After recording of the final map, the subdivision
shall be annexed without notice or hearing, to an existing
special district to operate and maintain the system.
The subdivider shall deposit with the County Department of
~Public Works $200.00 at the time the Lot Grading Plan
or Improvement Plan is submitted. The deposit will be made with
whichever plan is first submitted. Said deposit shall be used to
cover the cost of site inspection by a County Geologist to determine
whether or not any geologic hazard exists and, if such is found, to
review the geologic report prepared by the developer's Engineering
Geologist. The developer shall reimburse the County Department of
Tr:ns2ertatie~ Public Works for any cost in excess of the deposit
prior to recording the final map. Any unused portion of the deposit
will be refunded.
The subdivider shall deposit fees in the amount of Eighty Seven
Hundred Dollars ($8,700.00) with the Clerk of the Board of
Supervisors, or guarantee payment of those fees as may be required
pursuant to Sections 810.106 and 810.107 of the County Park Lands
Dedication.
The subdivider shall provide the Director of Tr:n:p:rt:ti:n Public
Works with documentation from a licensed cable television operator
~ng that arrangements for the underground installation of cable
television lines have been made or that a waiver of the underground
installation has been granted by the P!~nnin~ C~...~m._issi~n City
Council, upon consideration of a report by the CATV Review Commission
t at-~-~-~-~6-1icensed CATV operator is found to be willing and able to
install cable television lines in the subdivision.
The subdivider shall comply with Section 66436 of the Government Code
by furnishing to the County Department of Tr:ns2crt:ticn Public Works
a certification from each public utility and each public entity
owning easemetns within the proposed subdivision stating that: (a)
they have received from the developer a copy of the proposed fi;nal
map; (b) they object or do not object to the filing of the map
without their signature; (c) in the case of a street dedication
affected by their existing easement, they will sign a "subordination
certificate" or "joint-use certificate" on the map when required by
the governing body.

Prior to recordation of the final map, subdivider shall secure
recertifications satisfactory to the Director of T ......
Public Works of availability of adequate public services and
utilities including but not necessarily limited to: fire, ~chvv.s,
water and sewer services to the site, said recertifications dated
within 90 days prior to recordation.
No grading shall be permitted within this subdivision until
subdivider obtains sewer commitment from the District, to the
satisfaction of the Director of Department of
C ....... Public Works.
The developer shall relinquish all lot and private road access to
Midland Road and the 30 foot private easement road at the south
boundary of the subdivision known as Apache Road.
The developer shall participate in the cost of a future traffic
signal installation at Midland Road (SC 1732) and Camino Del Norte
and a future modification to the signal at Midland Road and Poway
Road, the amount of the developer's portion of the entire cost of

The developer shall place a $12,240.00 cash deposit in the Community
Services Agency Trust for the improvement of future Circulation
Element roads in the Poway area (5). The ~me?t of the deve!eper'~_
This approval is further conditioned by the following instructions to
staff:
The County Department of Tr:ns~ort~tion Public Works shall notify the Cits
Clerk c~hc Board of Supervisors and the Director of the Department of
Planning and Land Use to delete the provisional classification affixed to
the zoning encompassed by this subdivision.
The protection of the public interest requires that the subdivider,
contractors, builders, lot or parcel owners, and other persons, firms and
corporations concerned with the development of said subdivision conform to
the following standards, and all permits required by the Cc:nty cf S:n
Dic§$ City of Poway will be issued pursuant to such standards.
1. All domestic water supplied for this subdivision shall come from the
Poway Municipal Water District.
All buildings constructed in this subdivision shall be connected to
the public sewer system of the Pomerado County Water District.

Sewer and water lines shall not be laid in the same trench in any
part of this subdivision.
Proper drainage shall be maintained throughout this subdivision so as
to prevent ponding and/or storage of surface water that would create
a public health hazard or nuisance.

On April 14, 1981 the Poway City Council adopted
the attached Resolution of Approval on your tentative map
application, by a vote of 4 to O, with one men~)er absent.
The decision of the City Council is final, and there is
no appeal.
I, Marjorie K. Wahlsten, City Clerk of the City of Poway,
hereby certify that I have compared the attached copy with
the original Resolution passed and adopted by the City
Council of the City of Poway at a regular meeting thereof;
at the time and by the vote herein stated, which original
