A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
ESTABLISHING CONDITIONS FOR MITIGATION OF
ENVIRONMENTAL IMPACTS RESULTING FROM THE
DIVISION OF PROPERTY THROUGH PARCEL MAPS
WHEREAS, within the City of Poway many thousands of acres of land will
be subdivided through the Parcel Map procedure as prescribed by the Sub-
division Map Act, State of California Government Code Section 66410 et seq;
and
WHEREAS, such subdivision of properties will facilitate development
which will have an impact on infrastructure of the City of Poway including
schools, parks, public and private roads, bridges, and drainage channels;
and
WHEREAS, the City Council through the Environmental Impact Review
process as provided within the California Environmental Quality Act, State
of California Public Resources Code Section 21000 et seq. must specifically
add conditions to a proposed project to mitigate the impact on the com-
munity's infrastructure prior to approval; and
WHEREAS, the failure to impose such conditions would adversely impact
the health, safety, and welfare of all residents of the City of Poway; and
WHEREAS, private roads associated with division of properties by parcel
maps are often inadequately maintained, presenting potential hazards to
emergency vehicles and other vehicles used in the course of City business
and as such are a public nuisance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES RESOLVE,
DETERMINE AND ORDER AS FOLLOWS:
Section 1. Mitigation Conditions to be applied to Parcel Maps

Schools
The subdivider shall enter into agreements with the
Poway Unified School District in a form satisfactory to
the Poway City Council. Said agreements shall provide
for the payment to the District such sums of money or
other consideration which the City determines will
mitigate the impact of the subdivision upon said
District.
Parkland Dedication Fees
As a condition of any subdivision of property, parkland
dedication fees shall be required.

Other Mitigation Fees
Ail other circulation element fees, off-site drainage
fees, traffic signal fees, shall be applied to Parcel
Maps consistent with the procedure used for a major
subdivision.
Section 2. Private Road Construction and Maintenance Agreement
Ail private roads shall be paved, and the subdivider
shall enter into a private Road Construction and
Maintenance Agreement to insure that private roads will
be maintained to standards prescribed by law.

California, at a regular meeting thereof this 12th day of May, 1981.
