Ord 267ORDINANCE NO. 267 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA AMENDING CERTAIN SECTIONS OF TITLE 17 (ZONING DEVELOPMENT CODE) OF THE POWAY MUNICIPAL CODE, ZONING ORDINANCE AMENDMENT (ZOA 88-03) WHEREAS, the City Council periodically finds it necessary to amend Title 17 (Zoning Development Code) of its Municipal Code in response to changing conditions within the City; and WHEREAS, on July 26, 1988, the City Council adopted a resolution approving General Plan Amendment 88-02F which amended the Community Design Element of the General Plan of the Poway Comprehensive Plan regarding Objective No. 3 (Preservation of City-wide Building Scale and Variety) and Objective No. 11 (Housing Type and Style Variation) and regarding the deletion of Policy 13.k under Objective 13 (Lot Design orientation and Setbacks); and WHEREAS, the city Council finds that the zoning Development Code of the Poway Comprehensive Plan should also be amended to maintain consistency with the General Plan as required by Section 65860 of the California Government Code; and WHEREAS, a duly advertised public hearing was conducted in accordance with Section 65853, et seq., of the California Government Code and the california Environmental Quality Act to consider the proposed amendments and to provide interested parties the opportunity to address such. NOW, THEREFORE, BE IT ORDAINED by the city Council of the City of Poway the following: Section 1: Environmental Findings: The City Council finds that proposed zoning Ordinance Amendment (ZOA 88-03) will not have significant adverse impacts on the environment and hereby issues a Negative Declaration. Section 2: Amendments to the following sections of Title 17 (zoning Development Code) of the Poway Municipal Code are hereby established and shall read as follows: (Solid lines through language indicates deletion of language and underscored, dashed, language indicates a modification or addition to language.) Section 17.08.180, Special Requirements: R Zones is hereby amended by adding the new requirement (S) to read as follows: 17.08.180(S) Special Requirements - R Zones Tract subdivision construction in si~gle-famil~ residential zones shall be based uRon the followin~ ~e~uirements: A minimum of three floor ~lans shall be ~rovided u_p_to 50 units; a minimum of four p~ans shall be ~rovided for between 50 and 100 units; and one additional ~lan shall be ~rovided for each 50 additional units (or ~r~ thereof) over the first 100 units. - At least one one-stor_y_p~an shall be Rrovided. - A minimum of three facade treatments which var_y_estr_y~ window ty, p~ and treat- ment~ exterior materials~ and color shall be provided Re~ Rl~n. Ordinance No. 267 Page 4 Section 3: The City Council of the City of Poway hereby finds that these amendemnts are consistent with the General Plan and the intent and purpose of the Zoning Development Code. EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (30) days after the date of its passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a newspaper of general cir- culation published in the City of Poway.
