Ord 275ORDINANCE NO. 275 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA AMENDING TITLE 17 (ZONING DEVELOPMENT CODE) OF THE POWAY MUNICIPAL CODE (ZOA 88-08) WHEREAS, the City Council periodically finds it necessary to amend Title 17 (Zoning Development Code) of its Municipal Code in response to changing con- ditions within the City; and WHEREAS, the City Council of the City of Poway has initiated and approved a General Plan Amendment (GPA 88-03R) amending the text of the Land Use Element of the General Plan concerning the establishment of the "Residential Single Family-l" land use designation; and WHEREAS, the City Council has determined that it is necessary and desirable to amend Title 17 by adding provisions for the implementation of the "Residential Single Family-l" land use designations; and WHEREAS, the City Council held a duly advertised public hearing to provide interested parties the opportunity to address the proposed Zoning Ordinance Amendment (ZOA 88-08) in accordance with the California Government Code and the California Environmental Quality Act. NOW, THEREFORE, BE IT ORDAINED that the City Council does hereby adopt the following amendments as part of Title 17 (Zoning Development Code) of the Poway Municipal Code: Section 1: Environmental Findings: The City Council of the City of Poway hereby finds that Zoning Ordinance Amendment (ZOA 88-08) will not cause significant adverse impacts on the environment and hereby issues a Negative Declaration. Section 2: An amendment to Title 17 (Zoning Development Code) of the Municipal Code is hereby established by the addition of Section 17.080.25 to Chapter 17.08 (Residential Zones) and shall read as follows: Chapter 17.08 Residential Zones 17.080.25 RS-I Residential Single Family-1 Zone This zone is intended for low density single family residential land uses with a minimum lot size of one (1) acre and maximum densities of 1.0 unit per net acre. Additional uses are permitted that are complimentary to, and can exist in harmony with, low density neighborhoods. Ordinance No. 275 Page 2 17.08.090 Permitted and Conditional Uses: RS-1 Zone The permitted and conditional uses of the RS-1 zone shall be the same provided under Section 17.08.090 through Section 17.08.150, Permitted and Conditional Uses: R zones, and more specifically, pursuant to the provisions governing the RR-C zone. 17.08-160 Property Development Standards: RS-1 Zone The property development standards of the RS-1 zone shall be the same as pro- vided under 17.08.160 through 17.08.,230 for R zones, and more specifically, pursuant to the provisions governing the RR-C zone. Section 3: The City Council of the City of Pow~y hereby finds that this zoning ordi- nance amendment is consistent with the Poway General Plan and the intent and purpose of the Zoning Development Code and the California Government Code, Section 65450. EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (30) days after the date of its passage; and the City clerk of the City of Poway is hereby authorized to use sun,nary publication procedures pursuant to Government Code Section 36933 utilizing the Poway News Chieftain, a newspaper of general circulation published in the City of Poway.
