A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
CONSENTING TO THE ANNEXATION OF TERRITORY
IN THE CITY OF POWAY TO SAN DIEGO COUNTY
LIGHTING MAINTENANCE DISTRICT NO. 1
WHEREAS, property owners in the territory described in the attached
petition have petitioned the San Diego County Board of Supervisors for
annexation to San Diego County Lighting Maintenance District NO. l; and
WHEREAS, sixty two (62) percent of the property owners, owning property
in territory proposed to be annexed signed the petition of annexation; and
WHEREAS, Section 5837 of the California Streets and Highway Code
requires that if incorporated territory is sought to be annexed to a
lighting maintenance district, consent thereto shall first be obtained from
the legislative body of the City;
NOW, TF~EREFORE, BE IT RESOLVED, that the City Council of the City of
Poway hereby consents to annexation of the territory described in the
attached petition to San diego County Lighting Maintenance District No. 1.
PASSED AND ADOPTED BY THE City Council of the City of Poway, California
at a regular meeting thereof this 2nd day of June, 1981.

FORANNEXATION OF TERRITORY TO SAN DIEGO COUNTY
LIGHTING MAINTENANCE DISTRICT NO. 1
TO= Board of Supervisors
I/We, the undersigned owners of assessable real property, respectfully
petition that the hereinafter described territory be annexed to San Diego
County Lighting Maintenance DiStrict No. 1 pursuant to the provision of
Chapter 26, Part 3, Division 7 of the Streets and Highways Code.
We understand that if the real property described t~erein is included in
the District, the real property will be assessed annually to pay for the
operation and maintenance of the street lighting system in the District.
We further'understand that unless there is a District election the annual
assessments shall not exceed the amounts stated below for each ~!assification
of land:
MAXIMUM CHARGE LAND USE.CLASSIFICATION
$ 0.00 FOR All Vacant Land
16.00/Dwelling Unit FOR Residential
544.00/acre FOR Commercial
32.00/acre FOR Industrial
1.00/acre FOR FarmLand
96.00/acre FOR Institutional
16.00/acre FOR Recreational
We further understand that the start-up costs for this annexation are $2,080.00,
and that the portion of the start-up costs that includes the fees required
by the State Board of Equalization, and the cost to the County for processing
the annexation must be deposited with the County at the time the circulated
petition is submitted to the County for processing, and that this petition
will not be processed until these costs in the amount of $250.00 are paid.
We further understand that the remaining portion of the start-up costs of
$1,830.00 is for the operation and maintenance of the street lights from
the date of installation or energizing until June 30 of the year following
the year in which the territory is annexed, and if these costs are not
paid, the street lights will not be installed or energized until June 30 of
the year following the year in which the territory is annexed, and that any
~nused portion of the deposits will be refunded after annexation.
