AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA AMENDING SECTIONS
12.20.050, 12.20.060, 12.20.110, 12.20.120, and 17.08.180(P)
OF THE POWAY MUNICIPAL CODE, ESTABLISHING STANDARDS FOR THE
USE OF GRAVEL IN THE CONSTRUCTION OF NONDEDICATED
RURAL ROADS AND DRIVEWAYS IN RURAL AREAS
WHEREAS, the City Council has determined that an alternative to paving
roads and driveways in rural areas is appropriate; and
WHEREAS, a road or driveway must be capable of carrying a 20 ton fire
truck; and
WHEREAS, it is the intent of the City Council to establish standards for
the use of gravel in constructing nondedicated rural roads and driveways.
WHEREAS, the City Council held a properly noticed public hearing in accor-
dance with the California Government Code and the California Environmental
Quality Act to consider the proposed ordinance amendments.
NOW, THEREFORE, the City Council of the City of Poway does hereby ordain as
follows:

The City Council of the City of Poway does hereby amend the following sec-
tions of the municipal code:
12.20.050. Nondedicated Rural Street Specifications. All nondedicated
rural streets within the City limit lines, as noted on the adopted general plan
for the City, shall be constructed in accordance with specifications set forth
in Section 12.20.120 provided, however, that this provision may be waived under
appropriate circumstances.
12.20.060. Nondedicated Streets--Maintenance. A road construction and
maintenance agreement, in a form satisfactory to the City Attorney, shall be
executed by the developer and/or owner of any parcel serviced by a nondedicated
road as a condition of approval of any land division, building permit, or other
permit or grant of development approval for such parcel.

12.20.110. Criteria for Nondedicated Rural Street Standards--Designation.
E. (1) Paved Roads. Structural sections for private streets shall be
determined by the State of California Gravel Equivalent Hveem Stabilometer
Method, using the R-value of the native soil and traffic indices established by
the City. The minimum AC section shall be two inches. Base material will not
be required if the native soil has an R-value of 40 or greater. If the R-value
of the native soil is less than 40, the minimum base section shall be four
inches Class II base.
(2) Gravel Roads. In areas where a nondedicated rural road serves 10 or
fewer parcels, where the native soils have a minimum R-value of 60, minimum sand
equivalent of 30, minimum grade of 1% and a maximum grade of 10%, gravel roads
meeting the specifications outlined in Section 12.20.120 may be used.

Section 17.08.180.(P) is thereby modified to read as follows:

Vertical Curve (min. 50 ft. long) can be utilized with approval of the City
Engineer.
For slopes between 1% and 10%, gravel may be used based upon the following
specifications:
(1) The native soil must have a minimum R-value of 50 and minimum sand equiva-
lency of 20.
(2)
Scarify and compact the top 12" of subgrade to 95% relative compaction.
Over subgrade, compact the specified amount of Class II base to 95%, based
upon the following table:

(3) Drainage improvements and culverts must be installed to the satisfaction of
the City Engineer.

EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (30)
days after the date of its passage; and before the expiration of fifteen (15)
days after its passage, it shall be published once with the names and members
voting for and against the same in the Poway News Chieftain, a newspaper of
general circulation published in the City of Poway.
Introduced and first read at a regular meeting of the City Council of the
City of Poway, held the 15th day of November 1988, and thereafter PASSED AND
ADOPTED at a regular meeting of said City Council held the 29th day of November
1988 by the following roll call vote:
