A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA ESTABLISHING CONDITIONS AND
LIMITATIONS OF WATER SERVICE TO LANDS LYING
WITHIN ASSESSMENT DISTRICT NO. 79-1
WHEREAS, an "Engineer's Report" setting forth the particulars
of Assessment District No. 79-1 was received and approved by the
Poway City Council in Resolution No. 125 adopted July 14, 1981; and
WHEREAS, Pumping, Transmission and Storage Facilities to serve
water to lands lying within the proposed boundaries of said
"Assessment District" are planned to be constructed; and
WHEREAS, said facilities are sized only to meet the estimated
water demand~ of these lands as previously determined and as pro-
vided for in the proposed assessment formula included in Exhibit "E"
of said "Engineer's Report"; and
WHEREAS, the owners of each property within said "Assessment
District" were notified as to the water demand that was estimated
for their particular parcel along with the proposed limitation as
to water use and meter size; and
WHEREAS, said owners were provided the opportunity to either
confirm the estimated water demands or request an additional amount
of water allotment that would reflect an increase in assessment,
of which no such requests were received; and
WHEREAS, the Poway City Council on July 14, 1981 by Resolution
No. 123 approved and adopted the map designated "PROPOSED BOUNDARIES
OF ASSESSMENT DISTRICT NO. 79-1", said map being on file in the
office of the City Clerk.
NOW, THEREFORE, BE IT RESOLVED BY THE POWAY CITY COUNCIL AS
FOLLOWS:
For each parcel within Assessment District No. 79-1,
the maximum amount of water to be served from the
proposed water facilities within any 24 hour period
(maximum GPD) , shall not exceed the amount shown on
the attached "Schedule of Water Service Limitations
for Assessment District No. 79-1"
For each parcel within Assessment District No. 79-1,
the maximum size water meter that will be permitted
to serve each parcel shall not be larger than that
shown on the attached "Schedule of Water Service
Limitations for Assessment District 79-1'~

In the event that the existing or subsequent parcels
are divided, the limitations as to water service for
the resulting parcels shall be determined in the same
manner as was done for the parcel being divided.
4. The maximum permitted meter size to serve existing and
future parcels shall be determined by the following:

Enforcement of the provisions contained herein shall be
by means that is available to the City including, if
necessary, the installation of flow restrictive devices
ahead of the water meter.
In addition to the provisions contained herein, water
service to any and all parcels shall be subject to all
of the rules and regulations governing water service
that are then in effect in the City of Poway including
the payment of all required fees'and charges.
