AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
AMENDING SECTION 1G.38.040{B) OF THE
POWAY MUNICIPAL CODE FOR THE
DEDICATION OF PARKLAND, THE PAYMENT OF
IN-LIEU FEES OR COMBINATION THEREOF
FOR SUBDIVISIONS OF LAND
WHEREAS, the City Council has established regulations and procedures for the
dedication of parkland and the payment of in-lieu fees in accordance with
Section 66477 of the State Subdivision Map Act; and
WHEREAS, it is the desire of the City Council to revise said ordinance in
order that the City may continue to finance development of park facilities in
accordance with the goals and objectives of the Parks and Recreation Element of
the General Plan; and
WHEREAS, the City Council has considered the environmental findings and has
issued a Negative Declaration.
NOW, THEREFORE, the City Council of the City of Poway does hereby ordain as
follows:
Section 1. Section 16.38.040{B) of the Poway Municipal Code is hereby
amended to read as follows:
(B) The amount of in-lieu fees shall be computed by using the
following formula:
D--~- [ (P-C) ] : Total amount in dollars of in-lieu fees per dwelling
N unit.
WHERE:
C : Current estimated population as established each calendar year by
resolution of the City Council.
P : Ultimate population as established in the Land Use Element of the
General Plan.
Total estimated costs, as established each calendar year by resolu-
tion of the City Council, for development of public-owned parkland
designated on the Park and Recreation Element or Land Use and
Circulation Plan of the Comprehensive Plan.
Average population per dwelling unit based on single-family,
multiple-family and mobile homes as established each calendar year
by resolution of the City Council.

Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 29th day of November, 1988, and thereafter PASSED AND
ADOPTED at a regular meeting of said City Council held the 13th day of December,
1988, by the following roll call vote:
