Res 10-060RESOLUTION NO. 10 -060 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, APPROVING THE SIDE LETTER AGREEMENT BETWEEN THE CITY AND THE POWAY FIREFIGHTERS' ASSOCIATION WHEREAS, representatives with the Poway Firefighters' Association have met and conferred in good faith with representatives of the City of Poway in accordance with Government Code Section 3500 in an attempt to reach a memorandum of understanding regarding wages, hours, and other terms and conditions of employment, and WHEREAS, as a result of these meetings a recommended Side Letter Agreement has been prepared for employees represented by the Poway Firefighters' Association; and WHEREAS, the City Council of the City of Poway wishes to adopt said Side Letter Agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway that the Side Letter Agreement between the City of Poway and the Poway Firefighters' Association, attached hereto as Exhibit A, is hereby adopted retroactive to July 1, 2010 and shall be in effect through June 30, 2011. Troyan, MMC, City C of Poway SIDE LETTER AGREEMENT BETWEEN CITY OF POWAY AND POWAY FIREFIGHTERS' ASSOCIATION JULY 1, 2010 THROUGH JUNE 30, 2011 Whereas, the City of Poway ( "City ") is the employer of City of Poway employees; and Whereas, the Poway Firefighters' Association represents certain City employees (Safety Unit); and Whereas, the current Memorandum of Understanding (MOU) between the City and the Safety Unit is in effect through June 30, 2010; and Whereas, in an effort to help the City preserve services to the community, both parties have agreed to the following, without prejudice to its position and without waiving any rights, including but not limited to, the law, Meyers - Milias -Brown Act, and the MOU; and Whereas, both parties desire to operate under the provisions of the existing MOU, subject to certain conditions, for the period July 1, 2010 through June 30, 2011; and Whereas, both parties acknowledge that the City holds certain management rights not necessarily within the scope of bargaining, articulated in pan in Article 1, Section 313 City Rights, of the MOU. Now, therefore, the City and the Safety Unit hereby agree as follows: Effective pay period beginning July 12, 2010, all employees within the Safety Unit will pay 4% of their PF,RSable salary (excluding overtime) on a pre -tax basis toward the "member contribution" portion of their CalPERS retirement account. 2.
