AN ORDIN~CE OF THE CITY OF POWAY, CALIFORNIA
AMENDING CHAPTER 17.10 OF TITLE 17
(ZONING DEVELOPMENT CODE) OF THE
POWAY MUNICIPAL CODE
(ZOA 88-09)
WHEREAS, the City Council periodically finds it necessary to amend Title 17
(Zoning Development Code) of its Municipal Code in response to changing con-
ditions within the City; and
WHEREAS, the City Council has determined that is would be desirable to
establish small animal boarding kennels as a conditional use within the
Commercial General (CG) zones of the City of Poway and that such a land use
would provide a needed service to the residents of the community; and
WHEREAS, the City Council held a duly advertised public hearing in accor-
dance with the California Government Code and the California Environmental
Quality Act (CEQA) to provide interested parties the opportunity to address the
proposed zoning ordinance amendment (ZOA 88-09).
NOW, THEREFORE, the City Council does hereby ordain as follows:
SECTION 1: Environmental Findings
The City Council finds that zoning ordinance amendment (ZOA 88-09) will not
cause any significant adverse environmental impacts on the community and
hereby issues a Negative Declaration.
SECTION 2: City Council Action
Section 17.10.080 (General Commercial Uses) and 17.10.140 (Special
Requirements) of Chapter 17.10 (Commercial Zones) are hereby amended as
shown below by dashed-out language indicating a deletion and underscored
language indicating an addition.

Section 17.10.140 Special Requirements shall hereby be amended by adding
the following Special Requirement "H" which reads as indicated below:

In the CG zone, small animal boarding kennels

EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (30)
days after the date of its passage; and before the expiration of fifteen (15)
days after its passage, it shall be published once with the names and members
voting for and against the same in the Poway News Chieftain, a newspaper of
general circulation published in the City of Poway.

Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 20th of December, 1988, and thereafter PASSED AND ADOPTED
at a regular meeting of said City Council held the 3rd day of January, 1989 by
the following roll call vote:
