A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY~ CALIFORNIA
VACATING EXCESS RIGHT-OF-WAY OF A CITY
STREET, HIGHWAY OR PUBLIC SERVICE EASEMENT
WHEREAS, Harry L. Summers, Inc. has requested the vacation of the
hereinafter described portion of a City highway; and
WHEREAS, Section 8334 of the Streets and Highways Code, provides that the
City Council of any City may retain or may summarily vacate any portion of a
City Highway which portion is excess right-of-way and not required for said
highway; and
WHEREAS, the Director of Planning Services has recommended said portion of
City highway be vacated; and
WHEREAS, it appears to this Council that said portion of City highway as
recommended for vacation by said Director is not needed for present or
prospective use as a City highway.
NOW, THEREFORE, BE IT RESOLVED that this City Council finds that the
vacation of the hereinafter described City highway is consistent with the City
of Poway General Plan; and
BE IT FURTHER RESOLVED that this City Council finds that there is no
present or prospective public use for the hereinafter described portion of City
highway; and
BE IT FURTHER RESOLVED that the hereinafter described portion of City
highway be and is hereby vacated pursuant to the procedures prescribed by
Chapter 4 (commencing with Section 8330), Part 3, Division 9 of the Streets and
Highways Code:
