Ord 286 ORDINANCE NO. 286 ~ ORDIN/~NCE OF THE CITY OF POWAY, CALIFORNIA AMENDING TITLE 17 (ZONING-DEVELOPMENT'CODE) OF THE POWAY MUNICIPAL CODE (ZOA 89-01) WHEREAS, the City Council periodically finds it necessary to amend Title 17 (Zoning Development Code) of its Municipal Code in response to changing con- ditions within the City; and WHEREAS, the City Council of the City of Poway has initiated and approved a General Plan Amendment (GPA 89-01C) amending the text of the Housing Element of the Poway General Plan,~thereby establishing Action Program 2.K under Objective 2 (Reducing the Cost of New Housing) requiring common ownership of coaches and lots located within newly created, privately owned mobile home parks; and WHEREAS, the City Council has determined that it is necessary and desirable to amend Title 17 by adding provisions for the implementation of said new Action Program 2.K; and WHEREAS, the City Council held a duly advertised public hearing to provide interested parties the opportunity to address the proposed Zoning Ordinance Amendment (ZOA 89-01) in accordance with the California Government Code and the California Environmental Quality Act. NOW, THEREFORE, BE IT ORDAINED that the City Council does hereby adopt the following amendments as part of Title 17 (Zoning Development Code) of the Poway Municipal Code: Section 1: Environmental Findings: The City Council of the City of Poway hereby finds that Zoning Ordinance Amendment (ZOA 89-01) will not cause any significant adverse impact on the environment and hereby issue a Negative Declaration. Section 2: City Council Action: Title 17, Chapter 17.16 of the Zoning Development Code (MHP - MOBILE HOME PARK ZONE), Section 17.16.050 (SPECIAL REQUIREMENTS) shall be amended by adding new special requirement'"N" which shall read as indicated by the following dashed underscored language: N. Section 3: General Plan Consistency Finding: The City Council of the City of Poway hereby finds that this zoning ordi- nance amendment is consistent with the Poway General Plan and the intent-and purpose of the Zoning Development Code and the California Government Code, Section 65450. Ordinance No. 286 Page 2 EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (30) days after the date of its passage; and the City Clerk of the City of Poway is hereby authorized to use summary publication procedures pursuant to Government Code Section 36933 utilizing the Poway News Chieftain, a newspaper of general circulation published in the City of Poway.
