RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF POWAY, CALIFORNIA CONSENTING
TO ANNEXATION OF TERRITORY IN
THE CITY OF POWAY TO SAN DIEGO COUNTY
LIGHTING MAINTENANCE DISTRICT NO. 1
WHEREAS, the City of Poway standards requires the installation of
a street lighting system as part of the development process; and
WHEREAS, the City of Poway requires the developer to deposit with
the County of San Diego an amount of money sufficient to annex the
development to a special district to insure the continued operation
and maintenance of the street lights after they are installed and to
operate and maintain the street lighting system until tax or assessment
revenue from the territory accrues to the special district; and
WHEREAS, development projects that require street lights are annexed
to San Diego County Lighting Maintenance District No. 1; and
WHEREAS, the Director of the Department of Public Works of the
County of San Diego proposes to annex the development projects listed
in Exhibit "A" to San Diego County Lighting Maintenance District No. 1
to insure the continued operation and maintenance of the street lighting
system required as part of the development; and
WHEREAS, Section 5837 of the Streets and Highways Code requires the
consent of the City if incorporated territory is sought to be annexed to
a lighting maintenance district formed pursuant to Sections 5820 et. seq.
of the Streets and Highways Code;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Poway hereby consents to the annexation of the territory in the development
projects listed in Exhibit "A" and in the City of Poway to San Diego County
Lighting Maintenance District No. 1
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting thereof this 15th day of December
1981.
