A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
VACATING AN OPEN SPACE EASEMENT
(VAC 81-19)
WHEREAS, Tentative Parcel Map 14579 had a requirement for an open space
easement to protect certain environmentally sensitive biological resources; and
WHEREAS, the owner, Delbert L. Huges, granted such easement and it was
recorded; and
WHEREAS, the exclusion provided in the recorded legal description was in
error and did not provide the owner proper access; and
WHEREAS, it is the desire of the owner, City Planning Services Department
and City Council that said easement be vacated in order that the proper document
may be recorded;
NOW, THEREFORE, BE IT RESOLVED that pursuant to Chapter 4, Part 3, Division
9 of the Streets and Highways Code, the City Council of the City of Poway does
hereby vacate the open space easement described as:
Parcel No. 79-0895A
That portion of the West Half of Section 8 and that portion of the East
Half of Section 7, both in Township 13 South, Range 1 West, San
Bernardino Meridian, according to United States Government Survey, in
the County of San Diego, State of California, described as follows:
BEGINNING at a point in the Westerly line of said West half of Section
8 distant thereon North 00°25'57'' East 88.27 feet from the West Quarter
corner thereof; thence South 25°10'28" West a distance of 140.58 feet;
