A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
STATING INTENTION TO VACATE AND ABANDON CITY HIGHWAY
AND SETTING PUBLIC HEARING DATE
WHEREAS, the City of Poway has requested the vacation of the
hereinafter described city highway; and
WHEREAS, after investigation the City Department of Planning
Services has approved and recomended the proposed vacation; and
WHEREAS, Section 8320 of the Streets and Highways Code, provides
that the City Council, may, by resolution, declare its intention to vacate
any city highway; and
WHEREAS, it appears to this Council that said hereinafter
described highway is not needed for present or prospective use as a city
highway; NOW THEREFORE
BE IT RESOLVED by the City Council of the City of Poway that it
is the intention of this Council to vacate and abandon the following
described city highway pursuant to the procedures prescribed by Chapter 3
(cor, mencing with Section 8320), Part 3, Division 9 of the Streets and
Highways Code:
That portion of Rancho Caballo Road of Pomerado Gardens, Map No. 4282,
filedJuly 29, 1959 as File No. 153154, in the office of the County
Recorder of San Diego County, in the City of Poway, County of San Diego,
State of California, described as follows:
Beginning at the Southeast corner of Lot 76 of said Map 4282; thence
Northerly along the East line of said Lot 76, North 4 41' 00" West 95.00
feet to the beginning of a curve concave Southwesterly and having a radius
of 25.00 feet; thence Northerly, Northwesterly and Westerly along the arc
of said curve through a central angle of 90 00' 00" a distance of 39.27
feet; to a point of CUSP; thence North 85 19' 00" East 110.00 feet to the
beginning of a curve concave Southeasterly and having a radius of 25.00
feet, a radial bears North 4 41' 00" West, said beginning of curve on the
Northerly line of Lot 77 of said Map No. 4282; thence Westerly,
Southwesterly and Southerly along the arc of said curve through a central
angle of 90 00' 00" a distance of 39.27 feet; thence Southerly along the
Westerly line of said Lot 77, South 4 41' 00" East 95.00 feet; thence
South 85 19' 00" West 60.00 feet to the true point of beginning.
IT IS ORDERED that March 2, 1982, at the hour of 7 o'clock p.m.,
at City Hall Council Chamber, 13325 Civic Center Drive, is fixed as the
time and place for a hearing on this Resolution of Intention.
IT IS FURTHER ORDERED that the City Clerk of this City give notice
of the hearing of this resolution and of the time and place fixed for the
hearing of this resolution and of the time and place fixed for the hearing
by publication of a notice thereof in the Poway Chieftain, a newspaper of
general circulation published in the County of San Diego, for at least two
successive weeks prior to said day fixed for said hearing, and that the
Clerk also cause similar notices to be conspicuously posted along the line
of said highway proposed to be vacated as above described.
PASSED AND ADOPTED by the City Council of the City of Poway,
California at a regular meetin~ thereof this 9th day of February, 1982.
