A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DESIGNATING THE COUNTY OF SAN DIEGO
AS ITS AGENT FOR SERVICE OF PROCESS
WHEREAS, the Revenue and Taxation Code has been amended effective January 1,
1982, to provide that a city may desginate the County as its agent for services
of process for any and all actions brought against the city under Article 1 of
Chapter 5 of Part 9 of Division 1 of the Revenue and Taxation Code; and
WHEREAS, a city which has so designated the County as its agent for service
of process may at any time thereafter withdraw that designation; and
WHEREAS, a city that has so designated the County as its agent for service
of process shall file a copy of that designation with the County Clerk who shall
keep and maintain it as a public record; and
WHEREAS, Section 5149 requires the County to impose fees on a city which has
so designated the County as its agent for service of process to cover the costs
incurred pursuant to said section; and
W~EREAS, the Office of County Counsel, will pursuant to the Resolution of
the City Council, undertake the defense of such actions and bill the City its
proportionate share of the costs; and
WHEREAS, this Council desires to so designate the County of San Diego as its
agent for service of process and agrees to reimburse the County of San Diego by
payment of the City's prorated portion of the cost.
NOW, THEREFORE, BE IT RESOLVED that the City of Poway hereby designates the
County of San Diego as its agent for service of process for any and all actions
brought against the City under Revenue and Taxation Code, Section 5140 through
5161 and agrees to reimburse the Office of County Counsel for the City's
prorated portion of the cost.
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
