AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA REGU-
LATING THE USE OF VEHICLES UPON PRIVATE PROPERTY
AMENDING SECTION 76.101 OF THE CITY OF POWAY REGULA-
TORY ORDINANCES
THE CITY COUNCIL FOR THE CITY OF POWAY DOES ORDAIN AS FOLLOWS:
Section 1. The City Council finds that within the City of
Poway are vast areas of rural open space lands that have been used as
areas for racing, driving and abandoning vehicles. In many areas,
this use has caused adverse impacts upon the environment by leaving
the Slope areas bare and thereby vulnerable to serious erosion. Said
erosion is found to add incrimentally to the adverse silting of stream-
beds and thereby to the serious flooding problems within the City.
Further, this use has caused substantial damage to flora and wildlife
by direct destruction or retreat. In addition, the City finds the
above use a cause of fires in the rural areas, a source of noise
pollution, dust pollution and in many cases, the opportunity for van-
dalism. The use described herein is no longer within the control of
the property owner within the City and for the reasons above set forth,
is declared a public nuisance.
Section 2. Section 76.101 of the Regulatory Ordinances
for the City of Poway is deleted and/or amended to hereinafter read
as follows:
"Sec. 76.101.
(a) It shall be unlawful for any person to operate
or drive or leave any vehicle in, over or upon any private
property without having in possession the written per-
mission of the owner thereof, or the person entitled to
the immediate possession thereof, or the authorized agent
of either.
(b) Whenever any person is stopped by a peace
officer pursuant to this Section, he shall, upon the
request of such peace officer, display said written
permission."

Introduced and first read at a regular meeting of the
City Council of the CitY of Poway held the 26th day of May,
1981 and thereafter PASSED AND ADOPTED at a regular meeting of said
City Council held the 2nd day of June , 1981 by the
following vote:
